TAQLEED KE MA'NA AUR USKE AQSAM MEIN
Taqleed ke do ma'na hain
(a) ma'na loghawi (asli)
(b) ma'na sharei (sharae ke mutabiq)
TAQLEED ka ma'na loghawi hai کلادہ درگردن بستن gale mein haar ya patta dalna
TAQLEED ke sharei ma'na hain Kisi ke Qaulo fe'l ko apne upar Lazime sharaei janna yeh samajh kar ke uska kalam aur uska kam hamare liye hujjar(dalil) hai kiyun keh ye sharaei muhaqqiq hai Jaise keh ham masaaile shareiyah (shariat ke masaail) mein Imam saheb ka Qaul o fe'al apne liye DALIL samajhte hain Aur dalaaile shareiyah mein Nazar(ghaur o fikr) nahein karte

التَّقليد اتباعُ الـرَّجلِ غيرَه، فِيما سَمِعَہ، یقولُ اوفى فعلہ علیٰ زعمِ انّہ محققٌ بلا نظر فی الدلیل
Yahi ebarat Nurul Anwar bahse Taqleed mein bhi hai, Taqleed ke ma'na hain kisi shakhs ka apne ghair ki ita'at karna jo usko kahte huwe ya karte huwe sun le ye samajh kar ke woh ahle tahqiq mein se hain beghair dalil mein Nazar (gaur o fikr) kiye huwe
Niz Imame ghazali رحمۃ اللہ علیہ kitabul Mustafa j2/p387 mein farmate hain
اَلتَّقْلِیْدُ ھوَ قبُوْل ُقَولِِ بِلا حُجّۃ،ِِ مسلم الثبوت میں ھے التلیدالعمل بقول الغیرمن غیر

Tarjumah wahi hai jo upar bayan huwa
Is ta'reef se ma'loom huwa keh Huzoor صلی اللہ علیہ وسلم ki eta'at karne ko Taqleed nahein kahenge kiyun keh unka har Qaul o fea'l daleele sharei hai , taqleed mein hota hai daleele sharei ko nah dekhna lihaz ham Huzoor علیه الصلاۃ والسلام ke UMMATI HAIN NAH KE MUQALLID
Usi tarah sahaba e kiram wa aimma e deen Huzoor علیه السلام ke ummati hain Usi tarah Alimoon ki ita'at jo A'm musalman karte hain usko bhi taqleed nahein kaha jaega Kiyun keh koei bhi un A'limoon ki bat ya unke kam ko apne liye dalil nahein batata Balkeh ye samajh kar unki bat manta hai keh ye Maulwi Admi hain kitab se dekh kar kah rahe honge agar ye sabit hojae keh unka Qaul ya fatwa ghalat tha, kitab ke khilaf tha to koei bhi nah manein bar khilaf Qaule Imam Abu Haneefah رحمۃ الله علیہ ke agar woh Hadees ya Qura'n ya ijma e ummat ko dekh kar masalah farma dain to bhi qabool Aur apne qeyas (guman) se masalah farmadain to bhi qabool hoga YE ZAROOR YAAD RAHE.
Taqleed do 2/ tarah ki hai
Taqleede sharei,
aur ghair sharei
Taqleede sharei to shareeat ke ahkam mein kisi ki pairwi karne ko kahte hain , jaise Namaz Roze, Hajj, zakat waghairah ke masaeil mein Aimma-e-deen ki ita'at(pairwi) ki jati hai
Aur Taqleede ghair sharei hai Dunyawi Batun mein kisi ki pairwi karna, jaise Tabib (doctors) log ilme tib mein Bu Ali saina ki, aur shaer log (shero shaeri) mein Dagh dehlawi, Meer khusru, ya Mirza ghalib ki. Ya nahwi aur sarfi log (ilme nahw, ilme sarf) mein sibwayh, aur khalil ki pairwi karte hain. Usi tarah har peshawar apne peshe mein us fan ke mahireen ki pairwi karte hain. Yeh Taqleed dunyawi hai.
Sufiya e kiram jo wazaeif o a'mal mein apne mashaaikh ke Qaulo feal ki pairwi karte hain woh Taqleede dini to hai Magar Taqleede sharei Nahein balkeh Taqleed fittareeqat hai is liye keh ye sharei masaeil Haram o Halal mein Taqleed Nahein . Han jis cheez mein Taqleed hai woh dini kam hai.
Taqleede Ghair Shar’ei agar Shari’at ke khilaaf mein hai to Haraam hai, Aur agar Khilaaf E Islam na ho to Jaeiz hai, Budhi Ourtain apney Baap Dada’oun ki Ijaad ki huwi Shaadi Ghami ki un Rasmoon ki Pabandi Karain jo Khilaaf E Shari’at hain to Haraam hai , Aur Tabeeb Log jo Tibbai masail mein Bu ali Saina waghairah ki pairwee Karain jo keh Mukhaalif E Islam na hoon to Jaeiz hai.
Isi Pehli Qisam ki Haraam Taqleed ke baarey mein Qura'n kareem Jagah Jagah Mumani’at (rokna) farmata hai , aur aeisi Taqleed karney waalon ki burai bhi farmata ha.. َ
وَلَاﺗُﻄِﻊْ ﻣَﻦْ ﺍَﻏْﻔَﻠْﻨَﺎ ﻗَﻠْبَه، ﻋَﻦْ ﺫِﮐْﺮِﻧَﺎ ﻭَﺍﺗَّﺒَﻊَ ﮬَﻮَﺍﮦُ ﮐَﺎﻥَ ﺍَﻣْﺮُﮦ، ﻓُﺮُﻃََﺎ۰
Tarjuma:
Aur us ka kahana nah maano jis ka Dil ham ne
apni Yaad se Ghaafil kardiya, aur woh apni khawahish ke pichhe chala, aur us ka kam had se guzar gaya
وَاِنْ جَاهَدَاكَ عَلٰى أنْ تُشْرِكْ بِىْ مَا لَيْسَ لَكَ بِه عِلْمُ، فَلَاتُطِعْهُمَا
Aur agar woh tujhse koshish karain keh tu mera shareek thahra, usko jiska tujhe ilm nahein to unka kaha nah maan..
وَاِذَاقِیْلَ لَھُمْ تَعَالَوْا اِلٰی مآ أنْزَلَ اللّٰهُ وَاِلَی الرَّسُولِ قَالُوْا حَسْبُنَا مَا وَجَدْنَا عَلیْہِ اٰبَاءَنَا أوَلَوْکَانَ اٰبَآءُھُمْ لَا یَعْلَمُوْنَ شَیْئًاوَّ لَا یَھْتَدُوْنَ。
Aur jab unse kaha jaey keh Aawo us taraf jo Allah ne utara aur rasool ki tarf. Hamko Kahain ko woh bahut hai jis par hamne apne baap dada ko paya . kiya Agarche unke Baap, dada nah kuch janain aur nah Raah par hon
وَاِذَاقِیْلَ لَھُمُ اتَّبِعُوا مَآأنْزَلَ اللّٰه ُ قَالُوا بَل نتَّبِعُ مَا اَلْفَیْنَا علیه اٰبَاءَنا ۰
Aur jab unse kaha jae keh Allah ke utare huwe par chalo to kahein ke ham us par chalenge jis par apne baap dada ko paya
In mein Aur in jaisi a'yatun mein isi Taqleed ki buraei famaei gayi hai jo sharee'at Ke muqabile mein Jahil Baap Dadaoun ke haram kamon mein ki jawe, keh chunke hamare Baap Dada aisa karte the. Ham bhi aisa karenge chahe ye kam jaeiz ho ya nah jaeiz .
Rahi Taqleede SHAR'EI AUR AIMMA E DEEN KI ITA'AT, USSE UN A'yat KO KOEI. TA'LLUQ NAHEIN. IN. A'YATUN SE TAQLEED KO SHIRK BATANA ya haram kahna MAHAZ BE DEENI HAI.

KIN MASAIL MEIN TAQLED KIJATI HAI KIN MEIN NAHEIN
Taqleed E Shar’ai main kuch Tafseel hai, Shar’ai Masail Teen 3/Tarah ke hain
1. Aqaid (عقائد)
2. Wo kaam jo Saraa’hatan (zahiran) Qura'n pak ya hadees shareef se saabit hon, ijtihaad ko in mein dakhal na ho
3. Wo Ehkaam jo Quran ya Hadees se Istimbaat (chhant kar) O Ijtihaad (qeyas) kar k nikaaley jaein…
Aqaid main kisi ki Taqleed Jaeiz nahin..
ﺗﻔﺴﯿﺮ ﺭﻭﺡ ﺍﻟﺒﯿﺎﻥ ﺁﺧﺮ ﺳﻮﺭﮦ ﮬﻮﺩﺯﯾﺮ ﺁﯾﺖ. ﻧَﺼِﯿْﺒُﮭُﻢْ ﻏَيْﺮَ ﻣَﻨْﻘُﻮْﺽٍ
(Parah#12, Surah#11, Aayat#109) mein hai
وفی الاٰیۃ ذَمُّ التقلیدِ وھو قبول ُقولِ الغیرِ بلادَلیلِِ وھو جائز فی الفُروعِ والعمَلِیاتِ ولایجُوزُ فی اُصولِ الدِّینِ والْاِعْتِقادِیاتِ بل لَّابُدَّ منَ النَّظرِ والاِستِدلال
Agar koi ham se puchey ke Tauheed O Risaalat wagerah tum ne kaise maani. to yeh na kaha jawey ga ke Hazrat Imam Abu Haneefah ﺭﺿﯽ ﺍﻟﻠﮧ ﻋﻨﮭﮧ k farmaane se ya ke Fiqah Akbar se Balkey Dalaeil E Tauheed O Risaalat se kiun k Aqaid main Taqleed nahin hoti..

ای عماہ تعتقد ہ، من غير المسائل الفرعية مما علىٰ كل مكلف بلا تقليد لاحد وهو اهل السنة والجماعة وهم الاشاعرة والماتريدية
Tarjuma:
Yaani jin ka ham e'ateqaad rakhtey hain,
Furue'i masail k ilaawah k jin ka e'ateqaad rakhna har Mukal’laf par bager kisi Taqleed k waajib hai woh Aqaid wohi hain jin par Ahl-E-Sunnat Wa Jama’at hain aur Ahl-E-Sunnat Asha'irah aur Ma’tureediyah hain..

Niz Tafseer E Kabeer Parah#10) Zer-E-Aayat ﻓَﺎﺟِﺮْﮦُ ﺣَﺘّٰﯽ ﯾَﺴْﻤَﻊَ ﮐَلَاﻡَ ﺍﻟﻠّٰﮧِ
(Parah#10, Surah#9, Aayat#6) main hai
ﮬٰذِﮦ ﺍﻻٰﯾَۃُ ﺗَﺪُﻝُّ ﻋَﻠٰﯽ
ﺍَﻥَّ ﺍﻟﺘَّﻘﻠِﯿْﺪَ ﻏَﯿْﺮُ ﮐﺎﻑِِ ﻓﯽ ﺍﻟﺪِّﯾﻦِ ﻭﺍﻧَّﮧ ﻻ ﺑُﺪَّ ﻣﻦَ ﺍﻟﻨَّﻈْﺮِ ﻭﺍﻻِﺳْﺘِﺪْﻻﻝِ.『
((Tarjuma: Yeh Aayat-E-Kareemah is baat par Dalaalat karti hai k Usool E Deen mein Taqleed Ghair Kaafi hai, aur is mein Nazar-o-Istidlaal zaruri hai.. (Tafseer-E-Kabeer, Jild#15, Page#228, ))
Sareeh Ahkaam mein bhi kisi ki Taqleed jaeiz nahin, Paanch (5) Namazain, Namaz ki Rakatain,Tees (30)Rozey main khana peena haraam hona yeh woh Masail hain jin ka Saboot Nas (Qura'n O Hadees) se Saraahatan hai, is liye yeh na kaha jaega ke namazain Paanch is liye hain, ya Rozey ek Maah ke is liye hain keh Fiqahe Akbar main likha hai ya Imam Abu Haneefah (رحمۃ اللہ علیہ) ne Farmaya hai,
Balkeh is k liye Quran O Hadees se Dalael diye jaenge.
Jo Masail Quran O Hadees ya Ijma E Ummat se ijtihaad wa istimbat (Qura'n o hadis aur ijma'e ummat par qeyas) kar ke nikaaley jaein , un main Ghair Mujtahid par Taqleed karna waajib hai, Masail ki jo ham ne Taqseem kar di, aur bata diya ke kaun se masail Taqleediyah hain aur kause nahin, is ka bahut lihaz (khayal) rahey, Baaz Mauqeh par Ghair Muqallid Aeteraaz kartey hain ke Muqallid ko Haq nahin hota ke Dalaeil se Mas’ala nikaaley phir tum log Namaz Rozay k liye Qur’ani Aayatain ya Ahaadees kiyun pesh kartey ho,(?)
is ka jawaab bhi is amar (hukm) main aagaya k rozah, Namaz ki Farziyat Taqleedi ـ Masail se nahin yeh bhi maaloom huwa ke siwaa e Ahkaam E Khabar waghairah main Taqleed na hogi, jesey ke Kufr E Yazeed waghairah..
Niz Qeyaasi Masail main Fuqaha ka Qura'n O Hadees se Dalaeil Pesh karna sirf Maane huwey Masail ki Taae'id ke liye hota hai . woh Masail pehle hi se Qaul E Imam se Maane huwey hotey hain, to Bila Nazar FiDDaleel k yeh Mainey (Meaning) nahin ke Muqallid Dalaeil Dekhe hi nahin, Balkey yeh Dalaeil se Masa'il Hal na kare,

KIS PAR TAQLED KARNA WAJIB HAI KIS PAR NAHEIN
Mukallaf (A'qil o baligh) Musalmaan Do (2) Tarah k hain,
ek Mujtahid,
Dusre Ghair Mujtahid..
Mujtahid woh hai jis main is Qadar Ilmi Liyaqat aur Qabliyat ho k Qurani Isharaat O Ramooz samajh sakey aur Kalaam k Maqsad ko pehchan sakey is se Masail nikaal sakey , Naasikh O Mansookh ka Pura Ilm rakhta ho, Ilm Sarf-O-Naho-O-Balaagat wagerah main us ko puri mahaarat haasil ho , ehkaam ki tamam Aayaton aur Ahaadees par us ki nazar ho, is k ilaawah Zaki O Khush Faham ho, dekho Tafseeraat E Ahmadiyah wagerah k jo is Darjey tak na Pahunch saka woh Ger Mujtahid Ya Muqallid hai..
Ger Muqallid par Taqleed zaruri hai Mujtahid k liye Taqleed mana hai…
Mujtahid k 6 Tabqey hain:
1. ﻣﺠﺘﮩﺪ ﻓﯽ ﺍﻟﺸﺮﻉ
2. ﻣﺠﺘﮩﺪ ﻓﯽ ﺍﻟﻤذﮨﺐ
3. ﻣﺠﺘﮩﺪ ﻓﯽ ﺍﻟﻤﺴﺎﯾُﻞ
4. ﺍﺻﺤﺎﺏ ﺍﻟﺘﺨﺮﯾﺞ
5. ﺍﺻﺤﺎﺏ ﺍﻟﺘﺮﺟﯿﺢ
6. ﺍﺻﺤﺎﺏ ﺍﻟﺘﻤﯿﺰ
( ﻣﻘﺪﻣﮧ ﺷﺎﻣﯽ ﺑﺤﺚ ﻃﺒﻘﺎﺕ ﺍﻟﻔﻘﮩﺎﺀ )
1. ﻣﺠﺘﮩﺪ ﻓﯽ ﺍﻟﺸﺮﻉ : (1)Mujtahid fil shareye'
Woh hazrat hain jinhon ne Ijtihaad karney k Qawaid banae , Jesay Chaaron Imaam.. Imam Abu Haneefah , Imam Sha’fai , Imam Malik, Imam Ahmad Bin Hambal ﺭﺿﯽ ﺍﻟﻠﮧ ﻋﻨﮩﻢ ﺍﺟﻤﻌﯿﻦ
2. ﻣﺠﺘﮩﺪ ﻓﯽ ﺍﻟﻤذﮨﺐ : Mujtahid fil mazhab
Woh Hazraat hain, jo in usoolon main Taqleed kartey hain, aur in Usool se Masail E Shari’yah Far’iYah khud Istimbaat kar saktey hain , Jesay Imam Abu Yousuf O Muhammad Ibn E Mubarak ﺭﺣﻤﮩﻢ ﺍﻟﻠﮧ ﺍﺟﻤﻌﯿﻦ , keh yeh Qawaid main Hazrat Imam Abu Haneefah ﺭﺿﯽ ﺍﻟﻠﮧ ﻋﻨﮭﮧ k Muqallid hain, aur Masail main khud Mujtahid..
3. ﻣﺠﺘﮩﺪ ﻓﯽ ﺍﻟﻤﺴﺎﯾُﻞ :Mujtahid fil masail
Woh Hazrat hain, jo Qawaid aur Masail E Far’iyh donon main Muqallid hain , Magar woh Masail jin ke Muta’alliq A'emmah ki tasreeh· nahin milti , un ko Quran O Hadees wagerah ke Dalaeul se nikal saktey hain, jesay Imam Tahawi aur Qaazi khan Shams-ul-Aaemah Sir khusi wagerha ..
4. ﺍﺻﺤﺎﺏ ﺍﻟﺘﺨﺮﯾﺞ : Ash'abe takhreej.
Woh Hazraat hain, jo ijtihaad to bilKul hi nahin kar sakte haan Aaim’mah main se kisi ke Mujamal Qol ki Tafseel farma saktey hain , jesay Imam Karkhi wagerah ..
5. ﺍﺻﺤﺎﺏ ﺍﻟﺘﺮﺟﯿﺢ : Ash'be Tarjeeh
Woh Hazraat hain, jo Imam Sahab se chand Riwaayaat main se baaz ko tarjeeh de saktey hain , yaani agar kisi Mas’aley main Hazrat Imam Abu Haneefah ﺭﺿﯽ ﺍﻟﻠﮧ عنه k Do (2) Qol Riwaayat main aae to un main se kis ko Tarjeeh den, yeh woh kar saktey hain, isi tarah Jahaan Imam Sahab aur Saahibbain ka Ikhtalaaf ho to kisi k Qol ko Tarjeeh de saktey hain, k ﮨذﺍ ﺍﻭﻟٰﯽ ﯾﺎ ﮨذﺍ ﺍﺻﺢ wagerah jaisey Sahibe Qudoori aur Sahab Hidayah ..
6. ﺍﺻﺤﺎﺏ ﺍﻟﺘﻤﯿﺰ : Ash'be Tameez
Woh Hazraat hain, jo Zaahir mazhab aur riwaayaat naadrah isi tarah Qol Zae'eif aur Qawi aur Aqwa' mein Faraq kar saktey hain, k Aqwaal Mardoodah Riwayaat Za'eefah ko tark kardein , aur Sahih Riwayaat aur Mu’at’tabar Qol ko len , jesay k Sahib Kanz aur Sahib Dur-re-Mukhtar wagerah..

Jin (logun) main in 6 Wasfoon mein se kuch bhi na hoon, woh Muqallid mahaz (sirf) hain, jaisey hum aur Hamare Zamaney ke aam Ulama ke in ka Sirf yahi kaam hai k kitaab se Masail dekh kar Logun ko Bata dain..
Ham pahley Arz kar chuke hain k Mujtahid ko Taqleed karna Haraam hai , to in 6 Tabqon(darjun) mein jo Sahab jis Darje ke Mujtahid hongey, woh us Darjey se kisi ki Talqeed nahin karenge , aur is se Upar waaley Darjey mein Muqallid honge jesay Imam Abu Yousuf o Muhammad ﺭﺣﻤھما ﺍﻟﻠﮧ ﺗﻌﺎﻟﯽ k yeh Hazrat usool aur Qawaid mein to Imam E Aazam ﺭﺣﻤۃ ﺍﻟﻠﮧ ﻋﻠﯿﮧ ke Muqallid hain aur Masail mein Chunkay khud Mujtahid hain , is liye un main Muqallid nahin ..
Hamari is Taqreer se Ghair Muqallidon ka yeh Sawaal bhi uth gaya ke jab Imam Abu Yousuf O Muhammad ﺭﺣﻤﮩمـﺎﺍﻟﻠﮧ ﺗﻌﺎﻟﯽ Hanafee hain aur Muqallid hain to Imam Abu Haneefah ﺭﺣﻤۃ ﺍﻟﻠﮧ ﻋﻠﯿﮧ ki jagah jagah Mukhaalifat kiyun karte hain, to yahi kaha jawey ga ke Usool O Qawaid main yeh Hazrat Muqallid hain , is mein Mukhaalifat
nahin karte aur Furu’ai masail main Mukhalifat kartey hain , un mein khud Mujtahid hain, kisi ke Muqallid nahin..
Yeh Suwaal bhi uth gaya ke tum bahut se masail main saahibeen k Qaul par Fatawa dete ho, aur Imam Abu Haneefah ﺭﺣﻤۃ ﺍﻟﻠﮧ ﻋﻠﯿﮧ ke Qaul ko chhod dete ho, phir tum Hanafi kaise??
Jawab aagaya ke baaz darje ke Fuqaha Ashaab Tarjeeh bhi hain , jo chand Qauloon mein se Baaz ko Tarjeeh detey hain isi liye hum ko unhi Fuq’ha ka Tarjeeh diya huwa jo Qaul mila, usi par Fatwa diya gaya,
yeh suwaal bhi uth gaya ke tum apney aap ko Hanafi phir kiyun kehte ho?? Yousufi ya Muhammadi ya Ibn-E-Mubarak kaho! Kiyun ke bahut si jagah tum un ke Qaul par Amal kartey ho Imam Abu Haneefah ka Qaul chod kar, Jawab yahi huwa keh Chunkeh Imam Abu Yousuf o Muhammad o ibne Mubarak ﺭﺣﻤھم ﺍﻟﻠﮧﺗﻌﺎﻟﯽ ke tamaam Aqwaal Imam Abu Hanefah ﻋﻠﯿﮧ الرﺣﻤۃ ke usool uar Qawaaneen par baney hain , Lihaazah inmein se kisi ke bhi Qaul ko lena dar haqeeqat Imam Sahab hi ke Qaul ko lena hai , jaise Hadees par Amal Dar Haqeeqat Quran par hi amal hai ke Rab Ta’ala ne is ka Hukum diya hai,
Maslan Imam E Aazam ﺭﺣﻤۃ ﺍﻟﻠﮧ ﻋﻠﯿﮧ farmaatey hain , k koi Hadees Sahi saabit hojaawey to wahi mera Mazhab hai, ab agar koi Mujtahid Fil Mazhab koi Sahih Hadees Paa kar us par Amal karey to woh is se Ghair Muqallid na hoga , kiyun ke us ne is Hadees par Imam Sahab k is Qaeidey se Amal kiya, is ki Puri behes dekho

Imam Sahab ke is Qaul ka matlab yeh bhi hosakta hai ke jab koi Hadees Sahih saabit huwi hai to woh Mera Mazhab bani yaani har Mas’ala aur har Hadees mein main ne bahuat Jarah' Qadah aur Tehqeeq ki hai , tab usey Ekhtiyaar kiya, Chunanche Hazrat Imam k yahaan har Mas’ale ki Badi Chhaan been hoti thi, Mujtahid Shaagirdoon se Nihaayat Tahqeeqi Guftagu k baad ekhtiyar farmaya jaata tha Agar yeh Mukhtasar si taqreer khayal mein rakhi gai, to
bahut mushkiloon ko In sha ALLAH. hal kar degi,aur bahut kaam aawegi,
Baaz Ghair Muqallid kahtey hain k ham mein Ijtihaad karney ki Qoowat hai , lihaaza ham kisi ki Taqleed nahin kartey , is k liye Bahut Taweel (lambi) Guftugu ki Zarurat nahin, sirf yeh Dikhana chahta hun ke Ijtihaad k liye Kis Qadar Ilm ki Zarurat hai aur in hazrat ko woh Qoowat e Ilmi haasil hai ya nahin ※
Hazrat Imam Raazi, Imam Ghazali wagerah Imam Tarmizi O Imam Abu Da,oud wagerah Huzoor Gous-E-Pak , Hazrat Ba’Yazeed Bustami, Shah Baha’ul’Haq Naqshband , Islam mein aesey Paaya k Ulama O Mashaikh Guzrey k in par Ahl-E-Islam jis Qadar bhi Fakhar karey kam hai , magar in Hazraat mein se koi Sahab bhi Mujtahid na huwey, Balkey sab Muqallid hi huwey,, Khuwah Imam Shaf'ai k Muqallid hoon, Ya Imam Abu Haneefah k Muqallid hoon, رضى الله عنهم اجمــعــــــــــــين Zamana E Maujood mein kaun un ki Qaabiliyat ka hai ??,
jab in ka Ilm Mujtahid banney ke liye Kaafi nah huwa, to jin Be’chaaron ko abhi hadees ki kitaaboon k naam lena bhi na aatey hoon woh kis Shumaar main hain..
Ek Sahab ne Daawa-e- Ijtihaad kiya tha, Main ne ((Mufti Ahmed Yar Khan Naeemi Sahab)) un se Sirf itna Puchha k Aap Surah E Takaasur se kis qadar Mas’aley nikal saktey hain aur is mein Haqeeqat, Majaaz , Sareeh, O kinayah, Zaahir O Nash kitney hain , un Be’chaarey ne in cheezon k naam bhi na suney the

TAQLEED WAJIB HONE KE DALAAIL MEIN
Is bab mein ham 2/do fasl likhte hain
(1) pahli fasl mutlaqan Taqleed ke dalil mein
(2) dosri fasl Taqleed e shakhsi mein
FASL E AUWAL....
Taqleed ka Wajib Hona Qurani ayaat aur ahaadees e sahiha aur Amal e ummat Aur Aqwaal e Mufassireen se sabit hai, Taqleed mutlaqan, bhi aur Taqleed e mujtahideen bhi,Har ek Taqleed ka saboot hai
Aayat#1:
ﺍِﮬْﺪِﻧَﺎ ﺍﻟﺼِّﺮَﺍﻁَ ﺍﻟْﻤُﺴْﺘَﻘِﯿْﻢَ ﺻِﺮَﺍﻁَ ﺍﻟْـذِﯾْﻦَ ﺍَﻧْﻌَﻤْﺖَ ﻋَﻠَﯿْﮭِﻢْ۔
Tarjuma: “ Ham ko Seedha raasta chala, un ka rasta jin par tu ne Ehsaan kiya”∴
(Surah Fatiha, Parah#1, Aayat#5)
Is se maaloom huwa k siraat e mustaqeem wahi hai, jis par ALLAH k neik bandey chaley hoon aur Tamaam Mufassireen, Muhaddiseen, Fuqaha, Auliya ALLAH, Ghaus-O-Qutub-O-Abdaal ALLAH ke nek bandey hain ,
woh sab hi Muqallid guzrey hain, lihaazah Taqleed hi seedha raasta huwa, koi Muhaddis o Mufassir, Wali Ghair Muqallid na Guzra, Ghair Muqallid sirf woh hai jo Mujtahid na ho, Jo mujtahid ho kar taqleed na karey woh Ghair Muqallid nahin , kiyun keh Mujtahid ko Taqleed karna Mana hai.
Aayat#2:
لَایُکَلِّفُ اللّٰہُ نَفْساََاِلَّاوُسْعـــــَھَا
Tarjuma: “ ALLAH kisi Jaan par bojh nahin daalta magar uski Taaqat bhar”
(Surah Baqarah, Aayat#286)
Is Aayat se maaloom huwa k Taaqat se ziyadah kaam ki ALLAH kisi ko Takleef nahin deta, to jo shakhs ijtihaad na kar sakey aur Quran se Masaail na nikal sakey , us se Taqleed na karana, aur us se istimbaat karana taaqat se ziyadah bojh daalna hai, jab Ghareeb Aadami par Hajj aur Zakaat farz nahin, to Be-Ilm (jis k pass Ilm na ho) Insaan par Masaail ka istimbaat karna kiyun kar Zaruri hoga ??
Aayat#3:
ﻭَﺍلــﺳـَّﺎﺑِﻘُﻮْﻥَ ﺍلْأَ ﻭَّﻟُﻮْﻥَ ﻣِﻦَ ﺍﻟْﻤُھَﺎﺟِﺮِﯾْﻦَ ﻭَﺍﻻَﻧْﺼَﺎﺭِﻭَﺍﻟَّـذِﯾْﻦَ ﺍﺗَّﺒِﻌُﻮْﮬُﻢ
ﺑِﺎِﺣْﺴَﺎﻥِِ ﺭﺿﯽ ﺍﻟﻠﮧ
ﻋﻨﮭﻢ ﻭﺭﺿﻮﺍﻋﻨﮧ۔
Tarjuma: “ Aur sab mein Agley Pichhley Muhaajir o Ansaar aur jo bhalai k saath un k pairo (pairwi karne wala) huwey, ALLAH un se raazi aur woh ALLAH se Raazi ”
(Surah#9, Parah#11, Aayat#100)
Maaloom huwa k ALLAH un se raazi hai jo muhajireen aur ansaar ki ittibaa’ yaani Taqleed kartey hain , yeh bhi Taqleed huwi..
Aayat#4:
ﯾَﺎ ﺍَﯾُّﮭَﺎ ﺍﻟَّـذِﯾﻦَ ﺍٰﻣَﻨُﻮْﺍ ﺍَﻃِﯿْـعـُْﻮﺍ
ﺍﻟﻠّٰﮧَ ﻭَﺍَﻃِﯿْﻌُﻮْا ﺍﻟﺮَّﺳُﻮْﻝَ ﻭَ ﺍُﻭْﻟــِی ﺍلْاَﻣْﺮِ ﻣِﻨْﮑُﻢْ۔
Tarjuma: “ Ae Eemaan waalo! Etaa’at karo ALLAH ki, aur Etaa’at karo RASOOL ki aur Hukm waaloon ki jo tum mein se hoon”..
(Parah#5, Surah#4, Aayat#59)
Is Aayat mein 3/ Zaatoon ki Etaa’at ka hukm diya gaya hai, ALLAH ki (Quran) , RASOOL ﻋﻠﯿﮧ الــــﺳﻼﻡ ki (Hadees) Amr waalon ki (Fiqah-o-Istimbaat k Ulama) magar kalima-e-اطیعوا (ateea'u) do jagah laya gaya , Allah ke liye Aur Rasool علیہ السلام aur Hukm waloon ke liye ek.
Kiyun ke Allah ki sirf uske farmane mein hi etaa'at ki jaegi nah ke uske fe'al (kam)mein aur nah uske sukoot (khamooshi)mein woh kuffar ko rozi deta hai kabhi unko zahiri fatah (kamyabi) deta hai Woh kufr karte hain magar unko fauran azaab nahein bhejta Ham is mein Rab تعالى ki pairwi nahein kar sakte keh kuffar ki imdad (madad) karain Bar khilaf Nabi علیه السلام wa imam mujtahid ke keh unka har hukm har kam aur unka kisi ko kuchh karte huwe dekh kar khamoosh hona, Teenun chizoon mein unki pairwi ki jawegi,
is farq ki wajah se Do jagah اطیعوا (ateea'u) bola Agar koi kahe ke Amr waloon se murad sultan e islami hai to sultan-e-islami ki Etaa't shara'ee ahkam mein ki jawegi nah ke khilafe shara'e cheezun mein Aur sultaan (badshah) woh shara'i ahkam Ulamaa-e-mujtahideen se hi maa'loom karega Hukm to sab mein Faqeeh (Alim) ka hota hai islami sultan Mahaz (sirf) uska jaree karne wala hota hai Tamam ria'aya ka Haakim baadshah aur badshah ka haakim Alim mujtahid lihaza Nateejah nikla oululamrاولى الامر ulamaa-e-mujtahideen hi huwe agar badshah e islami murad lo jab bhi Taqleed to sabit ho hi gai yeh bhi khayal rahe ke a ayat mein Etaa't se murad shara'i. Etaa't hai
EK NUKTAH
IS aayat mein yeh bhi hai ke ahkaam teen tarah ke hain
Sarahatan Qura'n se sabit jaise keh jis Aurat ghair hamilah ka shohar marjae to uski iddat 4/mah 10/din hai unke liye hukm اطيعواالله hai..
dusre woh jo sarahatan Hadees se sabit hain, jaise ke chandi, sone ka zewar mard ko pahanna haram hai, uske liye farmaya gaya
اطيعوا الرسول
Teesre woh jo nah sarahatan Quran se sabit hain nah Hadees se, jaise chawal mein sood ki hurmat Qat'ei hai uske liye farmaya gaya. اولى الامر منكم
Teen tarah ke ahkaam aur teen hukm (ilm)
Aayat #5
فَاسْئَلُوْااَھْل َالذِّکْرِاِنْ کُنْتُمْ لَاتَعْلَمُوْنَ۰
(سورہ النحل آیت نمبر۴۳)
»to aey logo ilm waloon se puchho agar tumko ilm nahein«
is ayat se maaloom huwa keh jo shakhs jis masa'le ko nah janta ho woh Ahle ilm se daryaft (ma'loon) kare Woh ijtihaadi masaail jinke nikalne ki hamain taqat nah ho Mujtahideen se daryaf kiye jaenge, Ba'z log kahte hain ke usse n Murad Tareekhi waqiaat hain jaisa keh upar ki ayat se sabit hai Lekin ye sahi nahein hai, is liye keh is ayat ke kalimaat beghair Qaid ke hain aur puchhne ki wajah hai nah jaanna, to jis chiz ko ham nah jaante us chiz ka puchhna lazim hai
Aayat#6
وَاتَّـبـــــــَعْ سَبِـــــــــیْلَ مَنْ اَنَابَ اِلَــیَّ
»Aur uski raah chalo jo meri taraf rujoo'e laya«
(Surah 31 A#15)
Is ayat se ye bhi maaloom huwa ke Allah ki taraf rujoo'e karne waloon ki ittebaa'e (taqleed) zaruri hai ye hukm bhi A'm hai kiyun ke A'yat mein koi Qaid nahein
Aayat#7
وَالَّذِیْنَ یَقُوْلُوْنَ رَبَّنَا ھَبْ لَنَا مِنْ اَزْوَاجِنَاوَذُرِّیَّاتِنَا قُرَّۃَاَعْیُنِِ وَّاجْعَلْنَا لِلْمُتَّقِیْنَ اِمَا مًا۰
Aur woh jo Arz karte hain keh Aey hamare Rab hamko de hamari biviyun aur hamari aulaad se aankhoon mein thandak aur hamko parhezgaaroon ka peshwa bana
(Parah#19 surah#25 A#74)
Is ayat ki tafseer mein tafseer e muaa'limut tanzeel mein hai
فنقتدي بالمتقين ويقتدى بنا المتقون
Ham parhezgaroon ki pairwi karain aur parhezgaar hamari pairwi karein
Aayat #8
فَلَوْلَانَفَرَمِنْہ کُلِّ فِرْقَۃِِ مِّنْھُمْ طآئِفَـــــــۃٌ لِّیَتَفَقَّھُوْا فِی الدِّیْنِ
وَلِیُنْذِرُوْا قَوْمَھُمْ اِذَا رَجَعُوا اِلَیْھِمْ لَعَلّھُمْ
یَحذَرُوْنَ۰
Tarjuma: “ To kiyun na huwa k un k har Giroh mein se ek Jama’at nikley k deen ki samajh haasil Karain aur waapas aa kar apni Qaum ko Dar sunaein, is Umeed par k woh Bachein”..
(Parah#11, Surah#9, Aayat#122)
Is Aayat se maaloom huwa k har shakhs par mujtahid banna zaroori nahin, balkey ba’az taufeeqiyah baneinge aur ba’az dusroon ki Taqleed karein,
Aayat#9:
ﻭَﻟَﻮْ ﺭَﺩُّﻭْﮦ، ﺍِﻟَﯽ ﺍﻟﺮَّﺳُﻮْﻝِ ﻭَﺍِﻟﯽٰ ﺍُﻭﻟِﯽ ﺍلْاَﻣْﺮِ ﻣِ:ﻨْﮭُﻢْ ﻟَﻌَﻠِﻤَﮧُﺍﻟَّــذِﯾْﻦَ ﯾَﺴْﺘَﻨْﺒِﻄُﻮﻧَﮧ، ﻣِﻨْﮭُﻢْ۰۰
Tarjuma: “ Aur agar is mein RASOOL aur Amr waaley logoon ki taraf Rojoo’e kartey to zarur un mein se Haqeeqat jaan letay woh jo istinbaat karety hain”
(Parah#5, Surah Nisa,' Aayat#83)
Is se saaf maaloom huwa k Ahaadees aur Akhbaar aur Qurani Aayaat ko pehley istinbaat karney waley Ulama k saamney Pesh karey phir jis tarah woh farmadein us par amal Karein , Khabar se badh kar Quran o Hadees hai, lihaaza is ka Mujtahid par Pesh karna Zaroori hai.
Aayat#10:
ﯾَﻮﻡَ ﻧَﺪْﻋُﻮْﺍ ﮐُﻞَّ ﺍُﻧَﺎﺱِِمـ ﺑِﺎِﻣَﺎﻣِﮭِﻢ۔
Tarjuma: “ Jis din har Jama’at ko ham us k Imam k Sath bulaenge “
(Parah#15, Surah#17, Aayat#71)
Is ki Tafseer Rooh ul Bayaan main is tarah hai..
ﺍﻭ ﻣﻘﺪﻡ ﻓﯽ ﺍﻟﺪﯾﻦ ﻓﯿﻘﺎﻝ ﯾﺎ ﺣﻨﻔﯽ ﯾﺎ ﺷﺎﻓﻌﯽ۔
Tarjuma: “ Ya Imam Deeni Peshwa hai, Pas Qayaamat main kaha jawey ga, k Ae Hanafi, Aey Sha’fai “..

Is se maaloom huwa k Qayamat k din har insaan ko us k Imam se Bulaya jawey ga , Yun kaha jawey ga, k Ae Hanafiyon , Ae Shafiyo, Ae Malakiyo, Chalo !
To jis ne Imam hi na pakda us ko kis k saath bulaya jawey ga
Is k baarey mein Sofiya e Kiram farmaatey hain k jis ka koi Imam nahin us ka Imam Shaitaan hai .
Aayat#11
وَاذَِﺍ ﻗِﯿْﻞَ ﻟﮭُﻢ ﺍٰﻣِﻨُﻮا ﮐﻤَﺎ اٰﻣَﻦَ ﺍﻟﻨَّﺎﺱُ ﻗَﺎﻟُﻮآ ﺍَﻧُـؤْﻣِﻦُ ﮐَﻤﺎ ﺍٰﻣَﻦَ ﺍﻟﺴُّﻔَﮭـَآﺀُ۔
Tarjuma: “ Yaani jab un se kaha jaata hai, k aeisa
Eemaan lao jaisa yeh Mukhlis Momin Eeman lae to kehtey hain k kiya ham aesa Eemaan laaein jesa yeh Be-waqoof Eemaan lae.*
(Parah#1, Surah#2, Aayat#13)
Maaloom huwa k Eemaan bhi wohi Mu’a’tabar hai jo Saaliheen ka sa ho , to Mazhab bhi wohi theek hai jo Neik Bandoon ki tarah ka ho , aur woh Taqleed hai
AQWAAL E MUFFASAREEN WA MUHADDISEEN
دارمی باب الاقتدا ء بالعلمآء میں ھے
اَخْبَرَنَا یَعْلٰی قالَ اخبرنا عبدُ الْمَلِكِ عـــن عَطــــــاءٍ اَطـــــِیْعُوااللّٰهَ وَاَطيعُوا الرَّسُوْلَ واُولِى الْاَمْــــــرِ مِنْكُم قَالُوْااُوْلُوالْعِلْـــــــــمـــِ وَالْفِــــقْهِ
Khabar di hamko ya'alaa ne unhun ne kaha, mujhse kaha. Abdulmalik ne unhoone Ata' se riwayat ki keh eta'at karo Rasool ki (صلی الله علیہ وسلم) aur apne mein se amr (hukm) waloon ki, farmaya At'a ne ke aulool amr ilm aur fiqah wale hazrat hain
تـــفســــیر خازن زیر آیت فاسئلوا اھل الذکران کنتم لا تعلمون۰ فسئلوا المؤمنـــــینِ العٰلِمـیــــن مــــــن اھل
القــــــرآن
Tum unse puchho jo momin hain aur quran janne wale ulama hain *
تـــفسير درمنثوراسى آيت فاسئلوا الخـ.كى تفسير ميں هے
اَخرج اِبن مردَوَیْہ عــــن انسٍ قال سمعتُ النَّبیَّ صلی الله علیہ وسلمـــ یقول اِنَّ الرجلَ یُصَلِّی ویَصُومُ و یَحِجُّ وَیَغْزُو وَاِنَّہ لَمُنافقٌ قالوایارسول الله بِمَاذا دَخَلَ علیہ النَّفَاقُ قال َلِطَعْنِہ علٰی امامِہ وامامَہ، مَن قَال قالَ اللّٰه فِی کتابِہ فاسئلوا اھل الذکر ان کنتم لا تعلمون۰
Ibne mardaweih ne Hazrat Anas se riwayat ki, Farmate hain keh maine Huzoor علیہ السلام se suna ke farmate the ke baa'z shakhs Namaz padhte hain, roze rkhte hain, Haj, aur jihaad karte hain Halaanke woh munafiq hote hain, Arz ki ya rasoolullah kis wajah se un mein Nifaq a'gaya farmaya gaya apne imam par ta'nah (malamat) karne ki wajah se imam kaun hai? farmaya keh Rabتعالی ne farmaya
فاسئلوا. الآية٠
تفســــير صاوى سوره كهف وَاذْكُرْرَبَّكَ إذَانَسِيْتَ ki tafseer mein hai
وَلایجوزُ تقلید ماعَدَاالمذاھب الاربعۃَولو وافق قولَ الصحابۃِ والحدیْثَِ الصَّحیحَ والآیۃ َوالخارجُ عن المذاھب الاِربعۃَضَالٌّ مُّضِلٌّ وَّرُبَمَا اَدَّاہ ذٰالک الی الکفر لأنَّ لاَخذَ بظواھر الکتاب والسنَّۃِ من اُصول الکفر
Yani char 4 mazhaboon ke siwa kisi ki taqleed jaiz nahein, agarche woh sahaba ke qaul aur saheeh hadees aur ayat ke muwafiq hi ho, jo in char mazhaboon se kharij hai woh gumraah aur gumraah karne wala hai, kiyun ke Hadees wa qura'n ke mahaz zahiri ma'na lena kufr ki jad hai
AHADEES. احاديث
Muslim 1/54 Bab. Bayan. انَّ الدِّینَ النَّصیحۃُ mein hai
عن تمیم الدَّارِی اَنَّ النَّبِیَّ صلےاللہ علیه وسلم قال الدِّینُ النَّصیحَۃُ قلنا لمن قال لِلّٰہِ ولکِتابِہ وَلِرَسولِہ ولِاَئِمَّۃِ الْمُسْلِمین وعامَّتِھِمْ
Tameem dari se marwi hai keh Huzoor صلےاللہ علیہ وسلم ne farmaya keh deen khair khawahi hai Ham ne Arz kiya kis ki?
farmaya Allah ki aur uski kitab ki aur uske rasool ki aur musalmanun ke imamoon ki Aur A'm mu'minoon ki
Is hadees ki sharah mein Nawi mein hai
وقد يتناول ذالك على الأئمَّة ِالذين هم علمآءُالدين وإن من نصيحتهم قبول مارَوَوْهُ وتقليد هم فى الاحكام واحسانَ الظَّنِّ بِهم
Yeh hadees un imaamun ko bhi shamil hai jo ulamaae deen hain aur ulamaa ki khair khawahi se hai unki ruwayat ki huwi Ahadees ka qabool karna aur unke Ahkam mein taqleed karna unke sath neik guman karna,
DUSRI FASL TAQLEED E SHAKHSI KE BAYAN MEIN
Mishkat Kitab ul Emarah mein Ba-hawala Muslim hai keh HUZOOR (Sallalaho Alehe Wassallam) Farmaatey hain..
من اَتاکمُ وِاَمْرُکُم جَمیعٌ علی رجلِِ َواحِدِِیُّریْدُ ان یَّشُقَّ عصاکم ویُفَرِّقُ جَماعَتَکم فَاقْتُلُوہ..
Tarjuma: “Jo tumharey pass aawey Halaankey tum ek Shakhs ki Ata’at par Muttafiq ho , woh Chahta ho keh tumhari Laathi tod de, aur tumhari Jama’at ko Mutafarriq (juda) kar de, to us ko Qatal kardo*
Is mein murad Imam aur Ulama-e-Deen hi hain, kiyun keh Haakim e Waqt ki Ita’at Khilaaf e Shara'e Ahkaam mein Jaiz nahin Muslim ne Kitab ul Ammarah mein ek Baab baandha
ﺑﺎﺏ ﻭ ﺟﻮﺏ ﻃﺎﻋـۃِﺍﻻُﻣَﺮَﺍﺀ ﻓﯽ ﻏﯿﺮ ﻣﻌﺼﯿـۃ

Yaani Ameer ki Eta’at Gair Ma’siyat main Waajib hai , is se Maloom huwa k ek hi ki Eta’at Zaroori hai*
Mishkat Shareef kitabul buyooe babul faraiz mein Ba-riwaayat Bukhari hai k, Hazrat Abu Moosa Ash’ari ne Hazrat Ibn-e-Mas’ood ke
baarey mein Farmaya,
ﻻﺗَﺴْﺎَﻟُﻮْﻧِﯽ ﻓﯽ ﻣﺎﺩﺍﻡَ ﮬﺬﺍ ﺍﻟﺤﺒﺮُ ﻓﯿﮑﻢ
Jab tak keh yeh Allama tum mein Rahein, Mujh se Masail na puchho. .
(Sahih Bukhari, Kitaab ul faraeiz, Jild#2,Pa/997)
Maloom huwa keh Afzal ke Hotey huwey, Mafzool ki Eta’at na karey, aur har Muqallid ki Nazar mein apna Imam Afzal hota hai,
Fath-ul-Qadeer mein hai:
مَنْ تَوَلّٰی أَمْرَالْمُسْلِمِیْنَ شَیـئََافاسْتَعْمَلَ عَلَیْھِم رَجُلََاوَّ یَعْلَمُ أنَّ فیھِم من ھو اَولٰی بذالِکَ وَاعْلمُ منہ بکتَابِ الله وسُنَّۃِ رسُولِہ فقَدخانَ اللهَ ورسولَہ وجماعۃَالمسلمین
Tarjuma: “Jo Shakhs Musalmaanon ki Hukoomat ka Maalik ho, phir un par kisi ko Haakim banaey , Halankey jaanta ho k Musalmaanon mein is se ziyadah Mustahiq aur Quran o Hadees ka jaanney wala hai , to us ne ALLAH aur RASOOL (Alehissalam) aur Aam Musalmaanon ki Khayanat ki ”
Mishkat Kitaab ul ammarah Fasal Awwal mein hai,
ﻣﻦ ﻣﺎﺕ ﻭﻟﯿﺲ ﻓﯽ ﻋُﻨُﻘِﮧ ﺑَﯿْﻌَـۃٌ ﻣﺎﺕ ﻣَﯿْﺘـَۃَ ﺟَﺎﮬِﻠِﯿَّـۃِِ۔۔
Tarjuma: “ Jo Mar jaey, Halankey us ke Galey mein kisi ki Bai’at na ho, woh Jahalat ki Moat mara ”
( ﻣﺸﮑﻮٰۃ ﺷﺮﯾﻒ ﮐﺘﺎﺏ ﺍﻻﻣﺎﺭۃ ﻭﺍﻟﻘﻀﺎﺀ ﺍﻟﻠﻔﺼﻞ ﺍﻻﻭﻝ ۳۲۰، ﻣﻄﺒﻮﻋﮧ ﻧﻮﺭ ﻣﺤﻤﺪ

Is main Imam ki Bai’at yaani Taqleed aur Bai’at e Auliya sab hi daakhil hain , warna Bataaow Wahhabi is Zamaney mein kis Sultan ki bai’at mein hai.. ??
Ye chand Ayaat aur Ahaadees thein uske elawah aur bhi pesh ki ja sakti hain magar ikhtisaran usi par Qana'at ki gayei
Ab ummat ka amal dekho to taba'e taba'een ke zamane se abtak sari ummate marhumah is hi taqleed ke A'mil hain ke mujtahid nah ho woh ek mujtahid ki taqleed kare aur ijmae ummat par amal karna quran o hadees se sabit hai aur zaruri hai
Quran farmata hai:
وَمَنْ یُّشَاقِقِ الرَّسُولَ مِن بَعْدِماتَبَیَّنَ له ھُدیٰ وَیَتَّبِعْ غَیْرَسَبِیْل الْمؤمِنِینَ نُوَلِّہ مَاتَوَلّٰی وَنُصْلِہ جھنَّمَ وسآءَتْ مَصیرَ۰
Tarjuma: “ Aur jo RASOOL ki Mukhalifat kare aur Baad is key keh Haq Raasta is par khul chukka aur Musalmaanon ki Rah se juda raasta chaley ham us ko uski Haalat par chod denge , aur us ko Dozakh mein Daakhil karenge, aur kiya hi, buri jagah palatney ki hai

Jis se Maaloom huwa k jo raasta aam musalmaanon ka ho us ko ekhtiyar karna Farz hai aur Taqleed par Musalmaanon ka Ijma ( Yaani Musalmaanon ki Ziyadah Tadaad is Mas’aley k Haq mein) hai *
Mishkat Bab Al-Etesaam Bil Kitab o Sunnat mein hai..
اتبعوا السَّوَادالاَعظم فإنه من شَذَّشُذَّفى النار
Tarjuma: “ Badey Giroh ki Perwee karo, q k jo Jamat-ul-Muslimeen se Alahada raha, woh alahada kar k Jahannam mein Bheja Jawey ga”..

مارَاَہُ الْـمُؤْمنون حسَنََافھو عنداللہ حَسَنٌ
Tarjuma: “ Jis ko Musalmaan achha janen woh ALLAH k nazdeek bhi achha hai ”..

Ab dekhna yeh hai keh Aaj bhi aur is se pehley bhi Aam Musalmaan Taqleed E Shakhsi hi ko achha jaantey aae, aur Muqallid hi huwey , Aaj bhi Arab o Ajam mein Musalmaan Taqleed E Shahksi hi kartey hain , aur jo Gair Muqallid huwa woh Ijma ka Munkir huwa , Agar Ijma ka Etebar na karo, to Khilafat-e -Siddiqui o Farooqi kis tarah Saabit karogey, woh bhi to Ijma e Ummat se hi saabit huwi, yahaan tak k jo Shakhs in donon Khilaafaton mein se kisi ek ka Bhi Inkar karey woh kaafir hai ..
Dekho Shami Wagerah, isi Tarah Taqleed par bhi ijma huwa..
Tafseer e Khazin Zer e Aayat ﻭﮐﻮﻧﻮﺍ ﻣﻊ ﺍﻟﺼّٰﺪﻗﯿﻦ
(ﭘﺎﺭﮦ۱۱، ﺳﻮﺭۃ ۹، ﺍٓﯾﺖ ۱۱۹ ) Mein hai k Abu Bakar (Radi ALLAH Anhu) ne Ansaar se farmaya, k Qur’an Shareef ne Muhajireen ko Saadiqeen kaha
اولٰئک ھم الصّٰدقُون
(Parah 28, Surah 59, Aayat 8),
phir faramya, ﻭﮐﻮﻧﻮﺍﻣﻊ ﺍﻟﺼّٰﺪﻗﯿﻦ
Sachhon k saath raho,,, lihaazah tum bhi Alahadah Khilaafat Qaeim na karo, Hamarey saath raho..Isi tarah main bhi Gair muqallidon se kahta hun, k Sachhon ne Taqleed ki hai tum bhi in k saath raho, Muqallid bano..
AQLEE DALAIL..
Duniya mein Insan koi bhi kaam bageir Dusre ki perwee k nahin kar sakta, har Hunar aur ilm ke Qawaeid sab mein is k Mahireen ki Perwee karna hoti hai, Deen ka Muaamla to duniya se Kahin Ziyadah mushkil hai, is mein bhi is k Mahireen ki Perwee karna hogi..
Ilm e Hadees mein bhi Taqleed hai , k fulaan Hadees is liye Za'eef hai, k Bukhari ne ya fulaan Muhaddis ne Fulaan Raawi ko Za'eef kaha , is ka Qaul manna yeh hi to Taqleed hai , Quran ki Qir’at mein qariyon ki Taqleed hai , k Fulaan ne is tarah is Aayat ko padha hai, Qur’an k A'eraab, Aayaat sab meinTaqleed hi to hai , Namaz mein jab Jama’at hoti hai to Imam ki Taqleed sab Muqtadi kartey hain.
Hukumat-e-Islami mein Tamaam Musalmaan ek Badshah ki Taqleed kartey hain..
Rail (Train) main Bethtey hain, to ek Engine ki Saarey Rail (Train) waaley Taqleed kartey hain .. Gharz yeh k Insan har kaam mein Muqallid hai, aur khayal rahey k in sab soorton mein Taqleed e Shakhsi hai , Namaz ke Imam do (2) nahin, to Shari’at mein aap kis tarah 2 Imam Muqarrar kar saktey ho?

TAQLEED PAR AETERAZAAT AUR JAWABAAT KE BAYAN MEIN
Mas’ala E Taqleed par Mukhalifeen k Aeterazat do (2) tarah ke hain
Ek Wahiyat Taaney aur Tamaskharey (Illogical baaten) jin ke jawabaat zaruri nahin Dusre wo jis se Muqallideen ko Gair Muqallid dhoka
detey hain.aur A'm muqallideen dhoka kha lete hain, woh hasb zel hain
SAWAAL NO 1 :
Agar Taqleed zaruri thi to Sahaba e Kiram Muqallid kiyun na huwey?
Jawab:
Sahaba e Kiram ko kisi ki Taqleed ki zarurat na thi, woh to Huzoor (Sallalaho Alehe Wassallam) ki Sohbat ki barkat se tamaam Musalmaanon ke Imam aur Peshwa hain , keh Aaeimma E Deen Imam Abu Haneefah O Shafa’i wagerah (Radi ALLAH Anhuma) in Sahaba ki perwee kartey hain ..
Mishkat Baab Fazaeil ul Sahaba mein hai..
اصحابى كاالنجوم بِاَيِّهِم اِقْتدَيتُم إهتديتم
Tarjuma: “ Mere Sahaba sitaron ki tarah hain, tum jin ki Perwee karo ge, Hidayat paalo gey” (Mishkat Page#554,)
Ek aur jagah aata hai:
علیْکُمـ ْبِسُنَّتِی وَسنةِ الخُلَفآءِ الرَّاشِدیـــنَ
Tarjuma: “ Tum lazmi pakdo meri aur merey Khulafa e Rashideen ki Sunnat ko” (Sunan Ibn-e-Majah, Jild#1, Page#15-16, Raqam ul
Hadees 42-43,)
Yeh suwal to aeisa hai k jeisey koi kahey k ham kisi ke Ummati nahin, kiyun keh hamarey NABI (Sallalaho Alehe Wassallam) kisi ke Ummati na they , to Ummati na hona Huzoor (Sallalaho Alehe Wassallam) ki sunnat huwi , par us se kaha jaega k Huzoor (Sallalaho Alehe Wassallam) to khud Nabi hain , sab AAP ki Ummat hain ,woh kis ke Ummati hotey, hamko ummati hona zaruri hai, isi tarah Sahaba tamam Musalmaanon ke Imam hain , unka kaun Musalmaan Imam hota
Nahar se pani us khet ko diya jaeega jo darya se door ho, mukabbireen ki aawaz par wahi Namaz padhega jo imam se door ho, darya ke kinare wali khetun ko Nahar ki zarurat nahein, pahli suf ke muqtadiyun ko mukabbir ki zarurat nahein Sahaba e kiram saffe auwal ke muqtai hain woh bila wasta seena-e- pake Mustafa. صلی اللہ علیہ وسلمse faiz lene wale hain, ham chunkeh us darya se door hain, lihaza us nahar ke hajat mand hain, phir samandar se hazar ha darya jari hote hain jin sab mein pani to samandar hi ka hai magar un sab ke Nam aur raste alag hain koi ganga,kahlata hai koi jamna, Aise hi Huzoor Alaihissalam Ap Ramat ke samandar hain us seene mein se JO nahar iamam Abu hanifah ke seene se hoti.aaei use HANAFI kaha gaya, jo iamam malik ke seene se aaei use MALIKI KAHLAYA, pani sab ka ek hai magar nam juda gana Aur un Nahrun ki hamain zarurat padi nah ke sahaba e kiram ko jaise hadees ki isnad hamare liye hai hai nah ke sahaba ke liye
SAWAAL NO 2 :
Rahbari k liye Quran o Hadees kafi hain, in mein kiya nahin hai jo Fiqah se hasil karain Quran Farmaata hai:
وَلَارَطْبِِ وَّلایَابِسِِ اِلَّافِی کِتَابٍ مُّبِیْنٍ۰
Aur nahi hai koi tar aur khushk chiz jo ek roshan kitab mein likhi na ho = ( ﺳﻮﺭۃ ﺍﻟﻨﻌﺎﻡ ﺁﯾﺖ 59 )
Ek aur jagah aata hai:
وَلَقَدْیَسَّرْنَاالْقُرْآنَ للذِّکْرِفھَلْ مِن مُّدَّکِرٍ ۰
Tarjuma: “ Aur ham ne Quran ko Yaad karney k liye Aasaan farma diya, to hai koi Yaad karney wala” ..
(Parah#27, Surah#54, Aayat#17)
In Aayaton se Maloom huwa keh Quran mein sab kuch hai aur Quran sab ke liye Asaan bhi hai phir kisi Mujtahid ke Pass q Jaein?
Jawab:
Quran o Hadees beshak Rahbari ke liye Kaafi hain aur inmein sab kuchh hai magar unse masail nikalne ki qabiliyat hona chahiye samandar mein moti hain magar unko nikalne keliye gota zan (dubne wale) ki zarurat hai Aimma-e-mujtahideen is samandar ke gota zan hain, Tib (doctori) ki kitaboon mein sab kuchh hai magar hamko Hakim ke pas jana aur usse nuskha tajwiz karana zaruri hai, aimma e deen tabib hain. ولقد یسرناالقرآن. Mein farmaya hai ke hamne quran ko hifz karne ke liye aasan farmaya" (parah#27surah#54ayt#17)
nah ke usse masail nikalne ke liye Agar masail nikalna aasan hai to phir hadis ki bhi kiya zarurat hai aur quran mein sabkuchh hai, quran aasan hai, niz quran sikhaane keliye Nabi kiyun aaey, quran mein hai
وَیُعَلِّمُھُمُ الْکِتَابَ وَالْحِکْمَۃَ
Aur woh nabi unko kitabullah aur hikmat ki batain sikhate hain"
(parah#1,surah#2,ayat#129) quran o hadees Ruhaani dawaein hain aur Imam.ruhani tabib
SAWAAL NO 3 :
Quran e Kareem ne Taqleed karney waalon ki Buraiyan farmai hain, Farmaata hai
اِتَّخَذُوْا اَحْبَارَھُمْ وَرُھــْبَانَھُــمْ اَرْبَابََامًّـــنْ دُوْنِ اللّٰه ِ
Tarjuma: “Inhon ne apney Padriyon aur Jogiyon ko ALLAH ke Siwa khuda bana liya”
فَاِنْ تَنَازَعْتُم فِی شَیْئٍ فَرُدُّوْہُ اِلَی اللّٰه وَالرَّسُوْلِ'
Phir agar tum mein kisi bat ka jhagda uthe to Allah aur uske rasool ki taraf rujoo'e karo
واَنَّ.ھٰذَا صِرَاطِیْ مُسْتَقِیْمـاََ فَاتَّبِعُوْہُ وَلَاتَتَّبِعُواْالسُّبُلَ فَتَفَرَّقَ بِکُم
Tarjuma: “ Aur yeh k yahi mera Seedha Rasta hai to us par Chalo aur Raahein na chalo, keh tum ko us ki Raah se juda kar dengi”
قالُوابَل نَتَّبِعُ مَا اَلْفَیْنَا عَلَیہِ اٰبآءَنَا
Tarjuma: “To kaheinge balkey hum to us par Chalenge jis par apney Baap Dada,. ko Paya”
In Aayaat aur in jaisi dusri Aayaton se maloom hota hai k ALLAH aur RASOOL ke Hukum ke saamney Imamon ki baat manna Tareeqah-e-Kuffar hai aur seedha Rasta ek hi hai, Char Raastey Hanafi, Shafa’I wagerah Tedhey rastey hain..
Jawab:
Jis Talqeed ka Quran e Kareem ne mana kiya un ka Jawab hum pehley hi bab mein bayan kar chukey hain, (lihaazah aap Shuroo se is topic ko read out karlein..)
ﻭَﻻتَـَﺘَّﺒِﻌُوﺍﺍﻟﺴُّﺒُﻞَ
(Parah#5, Surah#4, Aayat#59)
Mein Yahoodiyat ya Nasraniyat wagerah Khilafe Islam raastey murad hain ..
Hanfi , Sha’fai wagerah chand alag alag raastey nahin, Balkeh ek Station ki Char(4) Sadkein hain , ya ek Darya ki Char (4) Nehrein hain , warna phir to Ger Muqallideen ki Jama’aten Sanai aur Gaznawi ka kiya hokum hai ? Chand raaste hote hain aqaid ke badalne se,(lekin hamare) Chaaron (4) Mazhab ke Aqaid Ek hi hain, Sirf Aamaal mein Faro'i Mas’ala hain, jesa ke Khud Sahaba Kiram mein Ikhtalaf raha
SAWAAL NO 4 :
ســـــــــوال. ﮨﻮﺗﮯﮨـوﮰ ﻣﺼﻄﻔﯽٰکی ﮔﻔﺘﺎﺭ
ﻣﺖ ﻣﺎﻥ ﮐﺴﯽکـﺎ ﻗﻮﻝو کردار
ﺩﯾﻦ ﺣﻖ ﺭﺍﭼﺎﺭ ﻣذھﺐ ﺳﺎ ﺧﺘﻨﺪ
ﻓﺘﻨﮧ ﺩﺭ ﺩﯾﻦ ﻧﺒﯽ ﺍندﺍ ﺧﺘﻨﺪ !
Jawab:
Yeh Shair asal mein Chakralviyon ka hai (Chakralvi woh hain, jo Hadith ko nahin maantey )
ﮨﻮﺗﮯ ﮨﻮﮰ ﮐﺒﺮﯾﺎ ﮐﯽ ﮔﻔﺘﺎﺭ
ﻣﺖ ﻣﺎﻥ ﻧﺒﯽ ﮐﺎ ﻗﻮﻝ ﻭ کـﺮدﺍﺭ
دوسرا شعر بھی اسی طرح
ﻣﺴﺠﺪ ﺩﻭ ﺧﺸﺖ ﻋﻠٰﯿﺤﺪﮦ ﺳﺎ ﺧﺘﻨﺪ

ﺳﻠﺴﻠﮯ ﺩﻭﻧﻮﮞ ﭼﺎﺭ، ﭼﺎﺭ ﻟﻄﻒ ﻋﺠﺐ ﮨﮯ ﭼﺎﺭ ﻣﯿﮟ
ﺁﺗﺶ ﻭ ﺁﺏ ﻭ ﺧﺎﮎ ﻭ ﺑﺎﺩﺳﺐ ﮐﺎ ﺍﻧﮩﯽ ﺳﮯ ﮨﮯ ثبات
ﭼﺎﺭ ﮐﺎ ﺳﺎﺭﺍ ﻣﺎﺟﺮﺍ ﺧﺘﻢ ﮨﮯ ﭼﺎﺭ ﯾﺎﺭ ﻣﯿﮟ
Char (4) ka Number to ALLAH عزوجل ko Bada hi piyara hai, Kitaben bhi Char (4) Bhejin , Aur Deen bhi Char(4) Banaey Insan ka Khameer bhi Char (4) hi cheezon se kiya Wagerah, jab maqsood ke char raste ghir gaye to wahan pahunchna na mumkin hai, Khana e ka'aba k Ird Gird Char (4) Taraf Namaz hoti hai,
Magar Rukh sab ka Kabey ko hota hai .
Aeise hi Huzoor (صلی اللہ علیہ وسلم) to Kaba e Eemaan hain, Charon Mazhabon ne Charon Raastey Gher liye hain ,
Wahhabi kis Raastey se Wahaan puhnchenge
Kisi ne kiya khoob kaha hai..
ﻣـذﮨﺐ ﭼﺎﺭﭼﻮﮞﭼﮩﺎﺭ ﺭﺍﮦاند
ﺑـہـﺮِ ﻣِﻨّﺖ ﺟُﻮ ﺟﺎﺩﮦ ﭘﯿﻤﺎﯼٔ
ﺧﻮﺩ ﯾﮑﮯ ﺑﯿﻨﯽ ﺍﺯ ﭼﮩﺎﺭ ﻃﺮﻑ
ﮐﻌﺒﮧ ﺭﺍﭼﻮﮞ ﺗﻮ ﺳﺠﺪﮦ ﺑﻨﻤﺎﯼٔ
Jis tarah Quran ke Hotey huwey Hadees ki zarurat hai ,usi Tarah Hadees ke Hotey huwey Fiqah ki Zarurat hai , Fiqah Qur’an o Hadees ki Tafseer hai, aur jo Hukum ke ham ko na Hadees mein miley na Qur’an mein, us ko Fiqah hi bayan farmaata hai
SAWAAL NO 5 :
Taqleed mein Gair E Khuda ko apna Hakam(faislah karne wala) banana hai, aur yeh Shirk hai. Lihaza taqleede shakhsi shirk hai Rabتعالٰیfarmata hai.َّ اِنِ الْحُکْم َاِلَّا لِلّٰهِ Nahein hai hukm magar Allah ka?
Jawab,:
Agar ghaire khuda ko hakam ya panch bana shirk hai To Hadees Maanna bhi Shirk hi hoga, aur is ke Sath sath Saarey Muhaddiseen , Mufassireen Mushrik hogaye, kiyun keh Tirmizi, Abu Dawud, Muslim wagerah Hazrat to Muqallid hain..
ﺟﻮ ﺗﯿﺮﯼ ﺗﻘﻠﯿﺪ ﺷﺮﮎ ﮬﻮﺗﯽ ﻣﺤﺪﺛﯿﻦ ﺳﺎﺭﮮ ﮨﻮﺗﮯ ﻣﺸﺮﮎ
ﺑﺨﺎﺭﯼ ﻭ ﻣﺴﻠﻢ ﺍﺑﻦ ﻣﺎﺟﮧ ﺍﻣﺎﻡ ﺍﻋﻈﻢ ﺍﺑﻮ ﺣﻨﯿﻔﮧ !
ﮐﮧ ﺟﺘﻨﮯ ﻓﻘﮧ ﻣﺤﺪﺛﯿﻦ ﮨﯿﮟ ﺗﻤﮩﺎﺭﮮ ﺧﺮﻣﻦ ﺳﮯ ﺧﻮﺷﮧ ﭼﯿﮟ ﮨﯿﮟ
ﮨﻮﮞ ﻭﺍﺳﻄﮯ ﺳﮯ ﮐﮧ ﺑﮯ ﻭﺳﯿﻠﮧ ﺍﻣﺎﻡ ﺍﻋﻈﻢ ﺍﺑﻮ ﺣﻨﯿﻔﮧ !
Jis riwayat mein ek Fasiq Raawi aajaey, woh riwayat Zaeef ya Mo’zoo hai , to jis Riwayat mein koi Muqallid aajaey to Mushrik aagaya, lihazah woh bhi Baatil ,phir Tarmizi o Abu Dawud to khud Muqallid hain , Mushrik huwey un ki Riwayatein khatam huwin, Buhkari wagerah bhi pehley hi khatam ho chukin,k woh Mushrikon k Shagird huwey, ab Hadees kahaan se laaogey ?
Quran farmaata hai:
وَاِنْ خِفْتُمْ شِقَاقَ بَیْنِھِمَا فَابْعَثُواحَکَمََا مِّنْ اَھْلِہ وَحَکَمََا مِّنْ اَھْلِـــھَــــــــــا
Tarjuma: “Aur gar tum ko miyan Biwi k Jhagdey ka khauf ho to ek Hakam Mard waalon ki taraf Bhejo aur ek Panch Aurat walon ki taraf se Bhejo”(Parah#5,Surah#4Aayat#35)
Hazrat Ali wa Mu’awiyah (Razi ALLAH Anhuma) ne Jang-e-Safeen mein Hakam Banaya hai, Khud Huzoor (Sallalaho Alehe Wassallam) ne Bani Qurezah k Muamle mein Hazrat Sa’d Ibn e Ma’az (Razi ALLAH Anhu) ko Hakam banaya, (Aapney Sawal mein jo Aayat likhi ) is k Meaning yeh hain k Haqeeqi Hakam Khudae Pak hi ka hai, aur jo is k Siwa k Ehkaam hain, Ulama O Fuqha aur Mashaikh ke isi Tarah Ehkaam e Hadees yeh Tamam Bil wasta Khudaey Ta’ala hi k Hukm hain, agar yeh Meaning hon k kisi ka Hukum Siwaey Khuda k Manna Shirk hai to Aaj Tamaam Duniya jajka Faisla Kachehriyon k Muqaddimat ko Maanti hai, Sab hi Mushrik hogaey..
SAWAAL NO 6 :
Qeyaas mujtaheede zan (gumaan) hai, aur zan karna gunah hai Quran khud farmata hai

Be-shak Imam Sahab (Razi ALLAH Annhu) ka yeh hokum hai k Agar mera Qol kisi Hadees k Muqabil waqey hojaey to Hadees par Amal karna merey Mazhab par Amal karn hai..
Yeh to Imam Sahab ka Intihai Taqwa hai, K agar aesa hojaey to tum Hadees par Amal karo, ab Ger Muqallidon se Sawal k is Zamaney mein aeisa konsa Muhaddis hai, jo Ahadees ka is Qadar Ilm rakhta ho k Tamaam Hadees phir is ki Tamaam Asnadon par Ittala rakhta ho, aur yeh bhi jaanta ho k Imam Sahab (Razi ALLAH Anhu) ne yeh Hukum kis Hadees se liya hai, hum logon ki Nazar Siha e Sittah se Aagey nahin hoti phir kis tarah Faisla kar saktey hain k Imam Sahab (Razi ALLAH Anhu) ka yeh Farmaan kisi Hadees se Makhooz nahin , Yun to Hadees main bhi aata hai.

Ab jis tarah yeh Kalam mardood hai, tumhara Qol bhi mardood hai..

Imam E Aazam bahut Bade Muhaddis they , Bagair Hadees Daani is qadar Masail kaise Istimbaat ho saktey the, in ki kitaab Musnade Imam Abu Haneefah aur Imam Muhammad ki kitaab Moa’tta Imame Muhammad se un ki' hadees Daani maloom hoti hai, Hazrat Siddique e Akbar (Radi ALLAH Anhu) ki riwaayat bahut kam milti hain to kiya woh Muhaddis na they?
Kami Riwayat Ehtiyat ki wajah se hoti hai,Imam Sahab ki tamam riwaayat Sahih hain, Kiyun k in ka zamana Huzoor se bahut Qareeb hai ,baad mein Ba’az Riwayat mein Zua’f paida huwa, Baad ka Zu’af Hazrat Imam ko Muzir (nuqsan) nahin karta,phir jis Qadar Asnad badhi, usi Qadar Zu’af bhi Peida huwa.*

Ba’az log yeh bhi kehtey hain keh Tum kehtey ho k Charon Mazhab Haq hain, yeh kis tarah ho sakta hai, Haq to sirf ek hi hoga, Imam Abu Haneefah farmatey hain k Imam ke Peechhey Surah Fatiha Parhna Makrooh e Tehreemi hai, Imam Shafa’I farmaatey hain k wajib hai, to ya to wajib hogi ya Makrooh, Donon Mas’aley Sahih kis tarah hosaktey hain?

Yeh hai k Haq k ma'ana (Meaning) yahaan Sahih ya k Waqeya ke Muwafiq nahin,Balkey Matlab yeh hai keh Charon Mazahib mein se kisi ki Perwee karlo Khuda k yahaan Pakad nahin hogi , Q k Mujtahid ki Khata bhi mu'aaf hai, Ameer e Mu’awiyah aur Maula Ali isi Tarah Ayesha Siddique’ah aur Hazrat Ali (radi ALLAH Anhum Ajma’een) mein jang bhi huwi , aur Haq par ek hi Sahab they, magar donon ko Haq par kaha jaata hai , yaani kisi ki Pakad IndALLAH nahin hogi, Jangal mein ek Shakhs ko Khabar nahin k Qibla (pachhim) kis taraf hai, us ne apni Raaey se Char(4) Rak’at, Char (4) taraf Parhin, q k Raaey badalti gai, yeh bhi Mounh pherta raha, Qiblah to ek hi taraf tha, magar Namaz Sahih hogi Charon (4) Qiblah Durust hain. Balkey Mujtahid Khata bhi karey to bhi ek Sawab paata hai, Quran e pak ne Hazrat Dawud (Alehs Salaam) ki ijtihaadi Khata aur Hazrat Suleman (Alehis Salam) ki Durusti raaey bayaan farmai, magar kisi par Etab na farmaya Balkey farmaya
ﮐـُلََّا ٰﺍﺗَﯿْﻨَﺎ ﺣُﮑْﻤََﺎ ﻭَ ﻋِﻠْﻤََﺎ,,
ﻣﺸﮑﻮٰۃ ﮐﺘﺎﺏ ﺍﻻﻣﺎﺭۃ ﺑﺎﺏ ﺍﻟﻌﻤﻞ ﻓﯽ ﺍﻟﻘﻀﺎﺀ ﻣﯿﮟ ﮨﮯ
اذا حكم الحاكم فاجتَهَدَ وَاَصَابَ فَلَه اَجرانِ واذاحكم فاجتهدفاَخْطَأَ فله اجرواحد
Tarjuma: “Jab k Haakim Faisla karey to ijtihaad kare aur Sahih karey to us ko Do (2) Sawab hain, aur jab Faisla karey aur ijtihaad karey aur Khata karey to us ko ek (1) Sawab hai(Mishkat ul Fasal ul Awwal, Page#324)
Is se yeh Aetraaz bhi uth gaya k agar Sha’fai Rafayaden karey to theek hai aur agar Geir Muqallid karey to Jurum hai, Q k Sha’fai Haakim e Shara Mujtahid se faisla kara kar Rafa’yaden kar raha hai, agar Galti karta hai to bhi Maaf hai, aur Chunkey Geir Muqallid ne kisi Mujtahid se faisla na karwaya, lihazah agar Sahih hi karta hai, tab bhi Khata kaar hai, jeisay k aaj agar Haakim k bager koi shakhs khud hi Qanoon ko haath mein le kar koi kaam karta hai to Mujrim hai, lekin agar Haakim Kachehri se Faisla kara kar woh hi kaam kiya to is par Jurm nahin , Haakim Jawab dey hoga, aur agar Haakim se bhi galti hogai, to bhi us ki pakad nahin hogi ..
Dekho Huzoor (Sallalaho Alehe Wassallam) ne Badar k Qediyon se Mahaz Qiyas par Fidya liya phir Aayat is k khilaaf aai, Maloom huwa k is Qiyas se Rab raazi nahin , Magar woh Fidyah ka Rupiya waapas na krwaya gaya, Balkey Irshaad huwa, ﻓَﮑُﻠُﻮْﺍ ﻣِﻤَّﺎ ﻏَﻨِﻤْﺘُﻢْ ﺣَﻼﻻً ﻃَﯿِّﺒﺎً
(Parah#10,Surah#8, Aayat#69) Woh Maal kha lo halale taiyib, Maloom huwa k Khata e Ijtihaadi par koi Pakad nahin

Shari’at ke Dalaeil Char (4) hain, Qur’an ,Hadees, Ijma-e-Ummat , Aur Qeyas.Ijma k Dalaeil to hum Bayan kar chukey hain keh Quran ka bhi Hukum hai aur Hadees ka bhi k Aam Jama’at ul Muslimeen k saath raho, Jo is se Elahadah huwa woh Jahannumi hai…
Qiyas k mana(Meaning) Lughat mein Andazah Lagana aur Shari’at mein kisi Fare’I Mas’ale ko Asal Mas’aley se illat aur Hukum mein Mila dena, Yaani ek Mas’ala aeisa Dar-Pesh aagaya, jis ka Saboot Quran o Hadees mein nahin milta to is ki Misl koi woh Mas’ala liya jo Quran o Hadees mein hai,us ke Hukum ki illat(Wajah)maloom kar ke yeh kaha keh Chunke woh illat yahaan bhi hai, lihaazah us ka yeh Hukum hai,
jaise kisi ne Puchha keh Aurat ke saath Iglaam (pichhe k muqam mein wati karna) karna keisa hai? Hum ne Jawab diya k Haalat-e-Hez main Aurat se Jama’a karna Haram hai, kiyun ?
Paleedi(napaki) ki wajah se, aur is mein bhi Palidi hai, lihaazah yeh bhi Haram hai , Pucha gaya k jis Aurat se kisi k Baap ne Zinaa kiya woh is ke liye Halaal hai ya nahin?
hum ne kaha k jis aurat se kisi ka Baap Nikah karey woh Bete ko Haraam hai, Wati ya Juziyat ki wajah se, lihaazah yeh aurat bhi Haraam hai , is ko Qiyaas kehtey hain, Magar Shart yeh hai k Qiyas karney waala Mujtahid ho , har kisi ka Qiyas Mu’tabar nahin ,
Qiyas asal mein Hukum e Shari’at ko zaahir karney waala hai khud mustaqil Hukum ka musbit nahin , Yaani Quran o Hadees ka Hukum hota hai, magar Qiyas isko yahaan
zaahir karta hai, Qiyas ka sabut Quran o Hadis o Af’aal e Sahaba se sabit hai.Quran farmata hai

Tarjuma: “To Ibrat lo, Ae Nigah waalo”

Yaani Kuffar k Haal par Khud ko Qiyas karo,keh Agar tum ne aeisi Harkat kin to tumhara bhi yahi haal hoga.Neez Quran ne Qayamat k honey ko Neend par,isi Tarah kheti k khushk ho kar SarSabz hone par Qiyaas farma kar bataya hai, Auwal se Aakhir tak Kuffar ki misalein Bayaan farmai hain, yeh bhi Qiyas hai.,.
Buhkari Kitab ul Aetisaam mein ek bab bandha hai
بابُ مَن شبَّهَ اَصْلاً مَّعلوماً بِاَصلِ مُّبينٍ قد بَيَّنَ اللّٰه حُكْمَهَا لِیَفْھَمَ بِه السَّائلُ
Jo kisi qaeidah-e-malumah ko aise qaeidah se tashbeeh de jiska hukm خدائےتعالیٰne bayan farma diya hai takeh saail us se samajh le* (Sahih Bukhari, Kitab ul Aetasaam, Jild#2, Page#1088, Matboo’a Qadeemi
Is mein (bab mein jo mazkur hu'a) ek Hadees Naqal ki, jis mein Huzoor(علیہ السلام) ne ek Aurat ko Qiyas se Hukum Farmaya:
انَّ امرأۃً جاءتْ الی النبی صلی الله علیہ وسلم فقالت ان اُمِّی نذرت اَن تَحُجَّ اَفَاَحُجُّ عنھا قال نعم حُجِّی عنھا ارءَیتِ لوکان. علیٰ اُمُّکِ دَین اَکنتِ قاضیۃٍقالت نعم قال اِقْضُوالَّذی له فان الله احَقُّ بالوفاءِ
Tarjuma: “Ek Aurat Huzoor (علیه السلا ) ki khidmat mein Haazir huwi, aur Arz kiya, k Meri Waalidah ne Hajj ki Nazr maani thi, kiya main us ki taraf se Hajj karun ? Huzoor ne Farmaya Haan Karo, Agar tumhari Maa par Qarz hota to tum usey Ada Kartin,Aurat ne Arz ki, haan karti, Huzoor ne Farmaya, Woh bhi Qarz ada karo jo ALLAH ka hai, q k ALLAH Ada-e-Qarz ka ziyadah Mustahik hai.(Sahih Bukhari,Jild#1,Page#25)
Mishkaat, kitaab ul Ammarah, aur Tirmizi Jild Awwal,aur Darimi mein hai k Jab Hazrat Mu'az Ibn-e-Jabal ko Huzoor (علیہ السلام) ne Yemen ka Haakim bana kar bheja to Puchha keh kis cheez se Faisla karoge? Hazrat Mu'az Ibn-e-Jabal ne Arz kiya, Kitabullah se, Huzoor ne Farmaya, Agar is mein na Paao to Hazrat Muaz Ibn-e-Jabal ne Arz ki, k ALLAH ke RASOOL ki Sunnat se , Huzoor ne faramya, agar usmein bhi na paao to?

اجتھد برائی ولا اٰلوقال فضرب رسول اللہ ﷺ علٰے صدرہ وقال الحمدلله الذی وفَّقَ رسولَ رسول الله لِمَایرضٰی به رسول الله
Tarjuma:
Apni Raae se Ijtihaad karunga,Raawi ne farmaya k Pas Huzur (علیہ السلام) ne un ke Seene par Haath maara, aur farmaya,ke us Khuda ka Shukar hai, jis ne Rasool ALLAH k Qaasid ko us ki Taufeeq di, jis se Rasool ALLAH raazi hain صلى الله عليه وسلم

Aaj k baad jis kisi pe koi Faisla aajaey to Quran Shareef se faisla karey, agar aesi cheez pesh aagai jo Quran Shareef mein nahin hai to us se Faisla karey jo ALLAH k NABI (Sallalaho Alehe Wa sallam)ne Faisla kiya , lekin aesi Cheez pesh aajae jo na Quran Shareef mein hai aur na us ka Faisla Nabi (Sallalaho Alehe Wa sallam) ne kiya, na Saliheen ne,to apne Qiyas se Ijtihaad karey ”
Imam Nasai isi Hadees k Mutalliq isi Jagah Farmaate hain:Tarjuma Yeh Hadees badi Khari hai, Badi khari hai ”..

Tarjuma: “ Inhen Hazrat Umar ne kaha k Quran shareef se faisla karo, , agar us mein na ho to Sunnat e Rasool se Faisla karo, aur agar na kitaab mein ho, na Sunnat E Rasool mein to us se Faisla karo jo ALLAH k Naik bandoon ne Faisla kiya ho, (Ijma e Ummat),lekin agar na to woh Mas’ala Quran mein ho, na Sunnat mein , aur na hi is k Mutalliq Saaliheen ka Faisla ho, to chaho to Pesh Qadmi karo,aur chaaho Muhlat lo, main tuhmare liye Muhlat hi ko Behtar jaanta hun.(Sunan Nisai,jild#2, Page#305)

انَّماالنَّجْوٰی من َالشَّیطٰنِ.

Mashwara karna Shaitan ki Taraf se hai.To kiya har Mashwara Sheitani kaam hai ?Nahin ..! Aakhir mei Munkireen-e-Qiyas se Daryaft karta hun k Jin cheezon ki Tasreeh Quran o Hadees mein na miley ya Bazahir Ahaadees se Ta'ruz waqie ho wahaan kiya karogey ?
Maslan: Hawai Jahaz mein namaz parhna kesa hai Isi tarah agar Juma'h ki namaz mein Raka’ate Awwal mein Jama’at thi, Dusri raka’at mein Jama’at Peechey se bhaag gai, ab zohar parhen ya Jumah?
isi tarah dusre masaile qiyasiyah mein kiya jawab hoga, Is liye behter hai k kisi Imam ka Daaman pakar lo,

Usi tarah sahaba e kiram wa aimma e deen Huzoor علیه السلام ke ummati hain Usi tarah Alimoon ki ita'at jo A'm musalman karte hain usko bhi taqleed nahein kaha jaega Kiyun keh koei bhi un A'limoon ki bat ya unke kam ko apne liye dalil nahein batata Balkeh ye samajh kar unki bat manta hai keh ye Maulwi Admi hain kitab se dekh kar kah rahe honge agar ye sabit hojae keh unka Qaul ya fatwa ghalat tha, kitab ke khilaf tha to koei bhi nah manein bar khilaf Qaule Imam Abu Haneefah رحمۃ الله علیہ ke agar woh Hadees ya Qura'n ya ijma e ummat ko dekh kar masalah farma dain to bhi qabool Aur apne qeyas (guman) se masalah farmadain to bhi qabool hoga YE ZAROOR YAAD RAHE.

Aur Taqleede ghair sharei hai Dunyawi Batun mein kisi ki pairwi karna, jaise Tabib (doctors) log ilme tib mein Bu Ali saina ki, aur shaer log (shero shaeri) mein Dagh dehlawi, Meer khusru, ya Mirza ghalib ki. Ya nahwi aur sarfi log (ilme nahw, ilme sarf) mein sibwayh, aur khalil ki pairwi karte hain. Usi tarah har peshawar apne peshe mein us fan ke mahireen ki pairwi karte hain. Yeh Taqleed dunyawi hai.
Sufiya e kiram jo wazaeif o a'mal mein apne mashaaikh ke Qaulo feal ki pairwi karte hain woh Taqleede dini to hai Magar Taqleede sharei Nahein balkeh Taqleed fittareeqat hai is liye keh ye sharei masaeil Haram o Halal mein Taqleed Nahein . Han jis cheez mein Taqleed hai woh dini kam hai.
Taqleede Ghair Shar’ei agar Shari’at ke khilaaf mein hai to Haraam hai, Aur agar Khilaaf E Islam na ho to Jaeiz hai, Budhi Ourtain apney Baap Dada’oun ki Ijaad ki huwi Shaadi Ghami ki un Rasmoon ki Pabandi Karain jo Khilaaf E Shari’at hain to Haraam hai , Aur Tabeeb Log jo Tibbai masail mein Bu ali Saina waghairah ki pairwee Karain jo keh Mukhaalif E Islam na hoon to Jaeiz hai.
Isi Pehli Qisam ki Haraam Taqleed ke baarey mein Qura'n kareem Jagah Jagah Mumani’at (rokna) farmata hai , aur aeisi Taqleed karney waalon ki burai bhi farmata ha.. َ
وَلَاﺗُﻄِﻊْ ﻣَﻦْ ﺍَﻏْﻔَﻠْﻨَﺎ ﻗَﻠْبَه، ﻋَﻦْ ﺫِﮐْﺮِﻧَﺎ ﻭَﺍﺗَّﺒَﻊَ ﮬَﻮَﺍﮦُ ﮐَﺎﻥَ ﺍَﻣْﺮُﮦ، ﻓُﺮُﻃََﺎ۰
Tarjuma:
Aur us ka kahana nah maano jis ka Dil ham ne
apni Yaad se Ghaafil kardiya, aur woh apni khawahish ke pichhe chala, aur us ka kam had se guzar gaya
وَاِنْ جَاهَدَاكَ عَلٰى أنْ تُشْرِكْ بِىْ مَا لَيْسَ لَكَ بِه عِلْمُ، فَلَاتُطِعْهُمَا
Aur agar woh tujhse koshish karain keh tu mera shareek thahra, usko jiska tujhe ilm nahein to unka kaha nah maan..
وَاِذَاقِیْلَ لَھُمْ تَعَالَوْا اِلٰی مآ أنْزَلَ اللّٰهُ وَاِلَی الرَّسُولِ قَالُوْا حَسْبُنَا مَا وَجَدْنَا عَلیْہِ اٰبَاءَنَا أوَلَوْکَانَ اٰبَآءُھُمْ لَا یَعْلَمُوْنَ شَیْئًاوَّ لَا یَھْتَدُوْنَ。
Aur jab unse kaha jaey keh Aawo us taraf jo Allah ne utara aur rasool ki tarf. Hamko Kahain ko woh bahut hai jis par hamne apne baap dada ko paya . kiya Agarche unke Baap, dada nah kuch janain aur nah Raah par hon
وَاِذَاقِیْلَ لَھُمُ اتَّبِعُوا مَآأنْزَلَ اللّٰه ُ قَالُوا بَل نتَّبِعُ مَا اَلْفَیْنَا علیه اٰبَاءَنا ۰
Aur jab unse kaha jae keh Allah ke utare huwe par chalo to kahein ke ham us par chalenge jis par apne baap dada ko paya
In mein Aur in jaisi a'yatun mein isi Taqleed ki buraei famaei gayi hai jo sharee'at Ke muqabile mein Jahil Baap Dadaoun ke haram kamon mein ki jawe, keh chunke hamare Baap Dada aisa karte the. Ham bhi aisa karenge chahe ye kam jaeiz ho ya nah jaeiz .
Rahi Taqleede SHAR'EI AUR AIMMA E DEEN KI ITA'AT, USSE UN A'yat KO KOEI. TA'LLUQ NAHEIN. IN. A'YATUN SE TAQLEED KO SHIRK BATANA ya haram kahna MAHAZ BE DEENI HAI.

ﺗﻔﺴﯿﺮ ﺭﻭﺡ ﺍﻟﺒﯿﺎﻥ ﺁﺧﺮ ﺳﻮﺭﮦ ﮬﻮﺩﺯﯾﺮ ﺁﯾﺖ. ﻧَﺼِﯿْﺒُﮭُﻢْ ﻏَيْﺮَ ﻣَﻨْﻘُﻮْﺽٍ
(Parah#12, Surah#11, Aayat#109) mein hai
وفی الاٰیۃ ذَمُّ التقلیدِ وھو قبول ُقولِ الغیرِ بلادَلیلِِ وھو جائز فی الفُروعِ والعمَلِیاتِ ولایجُوزُ فی اُصولِ الدِّینِ والْاِعْتِقادِیاتِ بل لَّابُدَّ منَ النَّظرِ والاِستِدلال

Tarjuma:
Yaani jin ka ham e'ateqaad rakhtey hain,
Furue'i masail k ilaawah k jin ka e'ateqaad rakhna har Mukal’laf par bager kisi Taqleed k waajib hai woh Aqaid wohi hain jin par Ahl-E-Sunnat Wa Jama’at hain aur Ahl-E-Sunnat Asha'irah aur Ma’tureediyah hain..

Niz Tafseer E Kabeer Parah#10) Zer-E-Aayat ﻓَﺎﺟِﺮْﮦُ ﺣَﺘّٰﯽ ﯾَﺴْﻤَﻊَ ﮐَلَاﻡَ ﺍﻟﻠّٰﮧِ
(Parah#10, Surah#9, Aayat#6) main hai
ﮬٰذِﮦ ﺍﻻٰﯾَۃُ ﺗَﺪُﻝُّ ﻋَﻠٰﯽ
ﺍَﻥَّ ﺍﻟﺘَّﻘﻠِﯿْﺪَ ﻏَﯿْﺮُ ﮐﺎﻑِِ ﻓﯽ ﺍﻟﺪِّﯾﻦِ ﻭﺍﻧَّﮧ ﻻ ﺑُﺪَّ ﻣﻦَ ﺍﻟﻨَّﻈْﺮِ ﻭﺍﻻِﺳْﺘِﺪْﻻﻝِ.『
((Tarjuma: Yeh Aayat-E-Kareemah is baat par Dalaalat karti hai k Usool E Deen mein Taqleed Ghair Kaafi hai, aur is mein Nazar-o-Istidlaal zaruri hai.. (Tafseer-E-Kabeer, Jild#15, Page#228, ))
Sareeh Ahkaam mein bhi kisi ki Taqleed jaeiz nahin, Paanch (5) Namazain, Namaz ki Rakatain,Tees (30)Rozey main khana peena haraam hona yeh woh Masail hain jin ka Saboot Nas (Qura'n O Hadees) se Saraahatan hai, is liye yeh na kaha jaega ke namazain Paanch is liye hain, ya Rozey ek Maah ke is liye hain keh Fiqahe Akbar main likha hai ya Imam Abu Haneefah (رحمۃ اللہ علیہ) ne Farmaya hai,
Balkeh is k liye Quran O Hadees se Dalael diye jaenge.
Jo Masail Quran O Hadees ya Ijma E Ummat se ijtihaad wa istimbat (Qura'n o hadis aur ijma'e ummat par qeyas) kar ke nikaaley jaein , un main Ghair Mujtahid par Taqleed karna waajib hai, Masail ki jo ham ne Taqseem kar di, aur bata diya ke kaun se masail Taqleediyah hain aur kause nahin, is ka bahut lihaz (khayal) rahey, Baaz Mauqeh par Ghair Muqallid Aeteraaz kartey hain ke Muqallid ko Haq nahin hota ke Dalaeil se Mas’ala nikaaley phir tum log Namaz Rozay k liye Qur’ani Aayatain ya Ahaadees kiyun pesh kartey ho,(?)
is ka jawaab bhi is amar (hukm) main aagaya k rozah, Namaz ki Farziyat Taqleedi ـ Masail se nahin yeh bhi maaloom huwa ke siwaa e Ahkaam E Khabar waghairah main Taqleed na hogi, jesey ke Kufr E Yazeed waghairah..
Niz Qeyaasi Masail main Fuqaha ka Qura'n O Hadees se Dalaeil Pesh karna sirf Maane huwey Masail ki Taae'id ke liye hota hai . woh Masail pehle hi se Qaul E Imam se Maane huwey hotey hain, to Bila Nazar FiDDaleel k yeh Mainey (Meaning) nahin ke Muqallid Dalaeil Dekhe hi nahin, Balkey yeh Dalaeil se Masa'il Hal na kare,

Mujtahid woh hai jis main is Qadar Ilmi Liyaqat aur Qabliyat ho k Qurani Isharaat O Ramooz samajh sakey aur Kalaam k Maqsad ko pehchan sakey is se Masail nikaal sakey , Naasikh O Mansookh ka Pura Ilm rakhta ho, Ilm Sarf-O-Naho-O-Balaagat wagerah main us ko puri mahaarat haasil ho , ehkaam ki tamam Aayaton aur Ahaadees par us ki nazar ho, is k ilaawah Zaki O Khush Faham ho, dekho Tafseeraat E Ahmadiyah wagerah k jo is Darjey tak na Pahunch saka woh Ger Mujtahid Ya Muqallid hai..
Ger Muqallid par Taqleed zaruri hai Mujtahid k liye Taqleed mana hai…

Woh Hazraat hain, jo in usoolon main Taqleed kartey hain, aur in Usool se Masail E Shari’yah Far’iYah khud Istimbaat kar saktey hain , Jesay Imam Abu Yousuf O Muhammad Ibn E Mubarak ﺭﺣﻤﮩﻢ ﺍﻟﻠﮧ ﺍﺟﻤﻌﯿﻦ , keh yeh Qawaid main Hazrat Imam Abu Haneefah ﺭﺿﯽ ﺍﻟﻠﮧ ﻋﻨﮭﮧ k Muqallid hain, aur Masail main khud Mujtahid..
3. ﻣﺠﺘﮩﺪ ﻓﯽ ﺍﻟﻤﺴﺎﯾُﻞ :Mujtahid fil masail
Woh Hazrat hain, jo Qawaid aur Masail E Far’iyh donon main Muqallid hain , Magar woh Masail jin ke Muta’alliq A'emmah ki tasreeh· nahin milti , un ko Quran O Hadees wagerah ke Dalaeul se nikal saktey hain, jesay Imam Tahawi aur Qaazi khan Shams-ul-Aaemah Sir khusi wagerha ..
4. ﺍﺻﺤﺎﺏ ﺍﻟﺘﺨﺮﯾﺞ : Ash'abe takhreej.
Woh Hazraat hain, jo ijtihaad to bilKul hi nahin kar sakte haan Aaim’mah main se kisi ke Mujamal Qol ki Tafseel farma saktey hain , jesay Imam Karkhi wagerah ..
5. ﺍﺻﺤﺎﺏ ﺍﻟﺘﺮﺟﯿﺢ : Ash'be Tarjeeh
Woh Hazraat hain, jo Imam Sahab se chand Riwaayaat main se baaz ko tarjeeh de saktey hain , yaani agar kisi Mas’aley main Hazrat Imam Abu Haneefah ﺭﺿﯽ ﺍﻟﻠﮧ عنه k Do (2) Qol Riwaayat main aae to un main se kis ko Tarjeeh den, yeh woh kar saktey hain, isi tarah Jahaan Imam Sahab aur Saahibbain ka Ikhtalaaf ho to kisi k Qol ko Tarjeeh de saktey hain, k ﮨذﺍ ﺍﻭﻟٰﯽ ﯾﺎ ﮨذﺍ ﺍﺻﺢ wagerah jaisey Sahibe Qudoori aur Sahab Hidayah ..
6. ﺍﺻﺤﺎﺏ ﺍﻟﺘﻤﯿﺰ : Ash'be Tameez
Woh Hazraat hain, jo Zaahir mazhab aur riwaayaat naadrah isi tarah Qol Zae'eif aur Qawi aur Aqwa' mein Faraq kar saktey hain, k Aqwaal Mardoodah Riwayaat Za'eefah ko tark kardein , aur Sahih Riwayaat aur Mu’at’tabar Qol ko len , jesay k Sahib Kanz aur Sahib Dur-re-Mukhtar wagerah..

Ham pahley Arz kar chuke hain k Mujtahid ko Taqleed karna Haraam hai , to in 6 Tabqon(darjun) mein jo Sahab jis Darje ke Mujtahid hongey, woh us Darjey se kisi ki Talqeed nahin karenge , aur is se Upar waaley Darjey mein Muqallid honge jesay Imam Abu Yousuf o Muhammad ﺭﺣﻤھما ﺍﻟﻠﮧ ﺗﻌﺎﻟﯽ k yeh Hazrat usool aur Qawaid mein to Imam E Aazam ﺭﺣﻤۃ ﺍﻟﻠﮧ ﻋﻠﯿﮧ ke Muqallid hain aur Masail mein Chunkay khud Mujtahid hain , is liye un main Muqallid nahin ..
Hamari is Taqreer se Ghair Muqallidon ka yeh Sawaal bhi uth gaya ke jab Imam Abu Yousuf O Muhammad ﺭﺣﻤﮩمـﺎﺍﻟﻠﮧ ﺗﻌﺎﻟﯽ Hanafee hain aur Muqallid hain to Imam Abu Haneefah ﺭﺣﻤۃ ﺍﻟﻠﮧ ﻋﻠﯿﮧ ki jagah jagah Mukhaalifat kiyun karte hain, to yahi kaha jawey ga ke Usool O Qawaid main yeh Hazrat Muqallid hain , is mein Mukhaalifat
nahin karte aur Furu’ai masail main Mukhalifat kartey hain , un mein khud Mujtahid hain, kisi ke Muqallid nahin..
Yeh Suwaal bhi uth gaya ke tum bahut se masail main saahibeen k Qaul par Fatawa dete ho, aur Imam Abu Haneefah ﺭﺣﻤۃ ﺍﻟﻠﮧ ﻋﻠﯿﮧ ke Qaul ko chhod dete ho, phir tum Hanafi kaise??
Jawab aagaya ke baaz darje ke Fuqaha Ashaab Tarjeeh bhi hain , jo chand Qauloon mein se Baaz ko Tarjeeh detey hain isi liye hum ko unhi Fuq’ha ka Tarjeeh diya huwa jo Qaul mila, usi par Fatwa diya gaya,
yeh suwaal bhi uth gaya ke tum apney aap ko Hanafi phir kiyun kehte ho?? Yousufi ya Muhammadi ya Ibn-E-Mubarak kaho! Kiyun ke bahut si jagah tum un ke Qaul par Amal kartey ho Imam Abu Haneefah ka Qaul chod kar, Jawab yahi huwa keh Chunkeh Imam Abu Yousuf o Muhammad o ibne Mubarak ﺭﺣﻤھم ﺍﻟﻠﮧﺗﻌﺎﻟﯽ ke tamaam Aqwaal Imam Abu Hanefah ﻋﻠﯿﮧ الرﺣﻤۃ ke usool uar Qawaaneen par baney hain , Lihaazah inmein se kisi ke bhi Qaul ko lena dar haqeeqat Imam Sahab hi ke Qaul ko lena hai , jaise Hadees par Amal Dar Haqeeqat Quran par hi amal hai ke Rab Ta’ala ne is ka Hukum diya hai,
Maslan Imam E Aazam ﺭﺣﻤۃ ﺍﻟﻠﮧ ﻋﻠﯿﮧ farmaatey hain , k koi Hadees Sahi saabit hojaawey to wahi mera Mazhab hai, ab agar koi Mujtahid Fil Mazhab koi Sahih Hadees Paa kar us par Amal karey to woh is se Ghair Muqallid na hoga , kiyun ke us ne is Hadees par Imam Sahab k is Qaeidey se Amal kiya, is ki Puri behes dekho
ﻣﻘﺪﻣﮧ ﺷﺎﻣﯽ ﻣﻄﻠﺐ ﺻﺢ ﻣﻦ ﺍﻻﻣﺎﻡ ﺍِﺫَﺍ ﺻَﺢَّ ﺍﻟْﺤَﺪِﯾْـثُ ﻓَﮭُﻮَ ﻣَﺬْھَﺒِﯽْ

Imam Sahab ke is Qaul ka matlab yeh bhi hosakta hai ke jab koi Hadees Sahih saabit huwi hai to woh Mera Mazhab bani yaani har Mas’ala aur har Hadees mein main ne bahuat Jarah' Qadah aur Tehqeeq ki hai , tab usey Ekhtiyaar kiya, Chunanche Hazrat Imam k yahaan har Mas’ale ki Badi Chhaan been hoti thi, Mujtahid Shaagirdoon se Nihaayat Tahqeeqi Guftagu k baad ekhtiyar farmaya jaata tha Agar yeh Mukhtasar si taqreer khayal mein rakhi gai, to
bahut mushkiloon ko In sha ALLAH. hal kar degi,aur bahut kaam aawegi,
Baaz Ghair Muqallid kahtey hain k ham mein Ijtihaad karney ki Qoowat hai , lihaaza ham kisi ki Taqleed nahin kartey , is k liye Bahut Taweel (lambi) Guftugu ki Zarurat nahin, sirf yeh Dikhana chahta hun ke Ijtihaad k liye Kis Qadar Ilm ki Zarurat hai aur in hazrat ko woh Qoowat e Ilmi haasil hai ya nahin ※
Hazrat Imam Raazi, Imam Ghazali wagerah Imam Tarmizi O Imam Abu Da,oud wagerah Huzoor Gous-E-Pak , Hazrat Ba’Yazeed Bustami, Shah Baha’ul’Haq Naqshband , Islam mein aesey Paaya k Ulama O Mashaikh Guzrey k in par Ahl-E-Islam jis Qadar bhi Fakhar karey kam hai , magar in Hazraat mein se koi Sahab bhi Mujtahid na huwey, Balkey sab Muqallid hi huwey,, Khuwah Imam Shaf'ai k Muqallid hoon, Ya Imam Abu Haneefah k Muqallid hoon, رضى الله عنهم اجمــعــــــــــــين Zamana E Maujood mein kaun un ki Qaabiliyat ka hai ??,
jab in ka Ilm Mujtahid banney ke liye Kaafi nah huwa, to jin Be’chaaron ko abhi hadees ki kitaaboon k naam lena bhi na aatey hoon woh kis Shumaar main hain..
Ek Sahab ne Daawa-e- Ijtihaad kiya tha, Main ne ((Mufti Ahmed Yar Khan Naeemi Sahab)) un se Sirf itna Puchha k Aap Surah E Takaasur se kis qadar Mas’aley nikal saktey hain aur is mein Haqeeqat, Majaaz , Sareeh, O kinayah, Zaahir O Nash kitney hain , un Be’chaarey ne in cheezon k naam bhi na suney the

TAQLEED WAJIB HONE KE DALAAIL MEIN
Is bab mein ham 2/do fasl likhte hain
(1) pahli fasl mutlaqan Taqleed ke dalil mein
(2) dosri fasl Taqleed e shakhsi mein
FASL E AUWAL....
Taqleed ka Wajib Hona Qurani ayaat aur ahaadees e sahiha aur Amal e ummat Aur Aqwaal e Mufassireen se sabit hai, Taqleed mutlaqan, bhi aur Taqleed e mujtahideen bhi,Har ek Taqleed ka saboot hai
Aayat#1:
ﺍِﮬْﺪِﻧَﺎ ﺍﻟﺼِّﺮَﺍﻁَ ﺍﻟْﻤُﺴْﺘَﻘِﯿْﻢَ ﺻِﺮَﺍﻁَ ﺍﻟْـذِﯾْﻦَ ﺍَﻧْﻌَﻤْﺖَ ﻋَﻠَﯿْﮭِﻢْ۔
Tarjuma: “ Ham ko Seedha raasta chala, un ka rasta jin par tu ne Ehsaan kiya”∴
(Surah Fatiha, Parah#1, Aayat#5)
Is se maaloom huwa k siraat e mustaqeem wahi hai, jis par ALLAH k neik bandey chaley hoon aur Tamaam Mufassireen, Muhaddiseen, Fuqaha, Auliya ALLAH, Ghaus-O-Qutub-O-Abdaal ALLAH ke nek bandey hain ,
woh sab hi Muqallid guzrey hain, lihaazah Taqleed hi seedha raasta huwa, koi Muhaddis o Mufassir, Wali Ghair Muqallid na Guzra, Ghair Muqallid sirf woh hai jo Mujtahid na ho, Jo mujtahid ho kar taqleed na karey woh Ghair Muqallid nahin , kiyun keh Mujtahid ko Taqleed karna Mana hai.
Aayat#2:
لَایُکَلِّفُ اللّٰہُ نَفْساََاِلَّاوُسْعـــــَھَا
Tarjuma: “ ALLAH kisi Jaan par bojh nahin daalta magar uski Taaqat bhar”
(Surah Baqarah, Aayat#286)
Is Aayat se maaloom huwa k Taaqat se ziyadah kaam ki ALLAH kisi ko Takleef nahin deta, to jo shakhs ijtihaad na kar sakey aur Quran se Masaail na nikal sakey , us se Taqleed na karana, aur us se istimbaat karana taaqat se ziyadah bojh daalna hai, jab Ghareeb Aadami par Hajj aur Zakaat farz nahin, to Be-Ilm (jis k pass Ilm na ho) Insaan par Masaail ka istimbaat karna kiyun kar Zaruri hoga ??
Aayat#3:
ﻭَﺍلــﺳـَّﺎﺑِﻘُﻮْﻥَ ﺍلْأَ ﻭَّﻟُﻮْﻥَ ﻣِﻦَ ﺍﻟْﻤُھَﺎﺟِﺮِﯾْﻦَ ﻭَﺍﻻَﻧْﺼَﺎﺭِﻭَﺍﻟَّـذِﯾْﻦَ ﺍﺗَّﺒِﻌُﻮْﮬُﻢ
ﺑِﺎِﺣْﺴَﺎﻥِِ ﺭﺿﯽ ﺍﻟﻠﮧ
ﻋﻨﮭﻢ ﻭﺭﺿﻮﺍﻋﻨﮧ۔
Tarjuma: “ Aur sab mein Agley Pichhley Muhaajir o Ansaar aur jo bhalai k saath un k pairo (pairwi karne wala) huwey, ALLAH un se raazi aur woh ALLAH se Raazi ”
(Surah#9, Parah#11, Aayat#100)
Maaloom huwa k ALLAH un se raazi hai jo muhajireen aur ansaar ki ittibaa’ yaani Taqleed kartey hain , yeh bhi Taqleed huwi..
Aayat#4:
ﯾَﺎ ﺍَﯾُّﮭَﺎ ﺍﻟَّـذِﯾﻦَ ﺍٰﻣَﻨُﻮْﺍ ﺍَﻃِﯿْـعـُْﻮﺍ
ﺍﻟﻠّٰﮧَ ﻭَﺍَﻃِﯿْﻌُﻮْا ﺍﻟﺮَّﺳُﻮْﻝَ ﻭَ ﺍُﻭْﻟــِی ﺍلْاَﻣْﺮِ ﻣِﻨْﮑُﻢْ۔
Tarjuma: “ Ae Eemaan waalo! Etaa’at karo ALLAH ki, aur Etaa’at karo RASOOL ki aur Hukm waaloon ki jo tum mein se hoon”..
(Parah#5, Surah#4, Aayat#59)
Is Aayat mein 3/ Zaatoon ki Etaa’at ka hukm diya gaya hai, ALLAH ki (Quran) , RASOOL ﻋﻠﯿﮧ الــــﺳﻼﻡ ki (Hadees) Amr waalon ki (Fiqah-o-Istimbaat k Ulama) magar kalima-e-اطیعوا (ateea'u) do jagah laya gaya , Allah ke liye Aur Rasool علیہ السلام aur Hukm waloon ke liye ek.
Kiyun ke Allah ki sirf uske farmane mein hi etaa'at ki jaegi nah ke uske fe'al (kam)mein aur nah uske sukoot (khamooshi)mein woh kuffar ko rozi deta hai kabhi unko zahiri fatah (kamyabi) deta hai Woh kufr karte hain magar unko fauran azaab nahein bhejta Ham is mein Rab تعالى ki pairwi nahein kar sakte keh kuffar ki imdad (madad) karain Bar khilaf Nabi علیه السلام wa imam mujtahid ke keh unka har hukm har kam aur unka kisi ko kuchh karte huwe dekh kar khamoosh hona, Teenun chizoon mein unki pairwi ki jawegi,
is farq ki wajah se Do jagah اطیعوا (ateea'u) bola Agar koi kahe ke Amr waloon se murad sultan e islami hai to sultan-e-islami ki Etaa't shara'ee ahkam mein ki jawegi nah ke khilafe shara'e cheezun mein Aur sultaan (badshah) woh shara'i ahkam Ulamaa-e-mujtahideen se hi maa'loom karega Hukm to sab mein Faqeeh (Alim) ka hota hai islami sultan Mahaz (sirf) uska jaree karne wala hota hai Tamam ria'aya ka Haakim baadshah aur badshah ka haakim Alim mujtahid lihaza Nateejah nikla oululamrاولى الامر ulamaa-e-mujtahideen hi huwe agar badshah e islami murad lo jab bhi Taqleed to sabit ho hi gai yeh bhi khayal rahe ke a ayat mein Etaa't se murad shara'i. Etaa't hai
EK NUKTAH
IS aayat mein yeh bhi hai ke ahkaam teen tarah ke hain
Sarahatan Qura'n se sabit jaise keh jis Aurat ghair hamilah ka shohar marjae to uski iddat 4/mah 10/din hai unke liye hukm اطيعواالله hai..
dusre woh jo sarahatan Hadees se sabit hain, jaise ke chandi, sone ka zewar mard ko pahanna haram hai, uske liye farmaya gaya
اطيعوا الرسول
Teesre woh jo nah sarahatan Quran se sabit hain nah Hadees se, jaise chawal mein sood ki hurmat Qat'ei hai uske liye farmaya gaya. اولى الامر منكم
Teen tarah ke ahkaam aur teen hukm (ilm)
Aayat #5
فَاسْئَلُوْااَھْل َالذِّکْرِاِنْ کُنْتُمْ لَاتَعْلَمُوْنَ۰
(سورہ النحل آیت نمبر۴۳)
»to aey logo ilm waloon se puchho agar tumko ilm nahein«
is ayat se maaloom huwa keh jo shakhs jis masa'le ko nah janta ho woh Ahle ilm se daryaft (ma'loon) kare Woh ijtihaadi masaail jinke nikalne ki hamain taqat nah ho Mujtahideen se daryaf kiye jaenge, Ba'z log kahte hain ke usse n Murad Tareekhi waqiaat hain jaisa keh upar ki ayat se sabit hai Lekin ye sahi nahein hai, is liye keh is ayat ke kalimaat beghair Qaid ke hain aur puchhne ki wajah hai nah jaanna, to jis chiz ko ham nah jaante us chiz ka puchhna lazim hai
Aayat#6
وَاتَّـبـــــــَعْ سَبِـــــــــیْلَ مَنْ اَنَابَ اِلَــیَّ
»Aur uski raah chalo jo meri taraf rujoo'e laya«
(Surah 31 A#15)
Is ayat se ye bhi maaloom huwa ke Allah ki taraf rujoo'e karne waloon ki ittebaa'e (taqleed) zaruri hai ye hukm bhi A'm hai kiyun ke A'yat mein koi Qaid nahein
Aayat#7
وَالَّذِیْنَ یَقُوْلُوْنَ رَبَّنَا ھَبْ لَنَا مِنْ اَزْوَاجِنَاوَذُرِّیَّاتِنَا قُرَّۃَاَعْیُنِِ وَّاجْعَلْنَا لِلْمُتَّقِیْنَ اِمَا مًا۰
Aur woh jo Arz karte hain keh Aey hamare Rab hamko de hamari biviyun aur hamari aulaad se aankhoon mein thandak aur hamko parhezgaaroon ka peshwa bana
(Parah#19 surah#25 A#74)
Is ayat ki tafseer mein tafseer e muaa'limut tanzeel mein hai
فنقتدي بالمتقين ويقتدى بنا المتقون
Ham parhezgaroon ki pairwi karain aur parhezgaar hamari pairwi karein
Aayat #8
فَلَوْلَانَفَرَمِنْہ کُلِّ فِرْقَۃِِ مِّنْھُمْ طآئِفَـــــــۃٌ لِّیَتَفَقَّھُوْا فِی الدِّیْنِ
وَلِیُنْذِرُوْا قَوْمَھُمْ اِذَا رَجَعُوا اِلَیْھِمْ لَعَلّھُمْ
یَحذَرُوْنَ۰
Tarjuma: “ To kiyun na huwa k un k har Giroh mein se ek Jama’at nikley k deen ki samajh haasil Karain aur waapas aa kar apni Qaum ko Dar sunaein, is Umeed par k woh Bachein”..
(Parah#11, Surah#9, Aayat#122)
Is Aayat se maaloom huwa k har shakhs par mujtahid banna zaroori nahin, balkey ba’az taufeeqiyah baneinge aur ba’az dusroon ki Taqleed karein,
Aayat#9:
ﻭَﻟَﻮْ ﺭَﺩُّﻭْﮦ، ﺍِﻟَﯽ ﺍﻟﺮَّﺳُﻮْﻝِ ﻭَﺍِﻟﯽٰ ﺍُﻭﻟِﯽ ﺍلْاَﻣْﺮِ ﻣِ:ﻨْﮭُﻢْ ﻟَﻌَﻠِﻤَﮧُﺍﻟَّــذِﯾْﻦَ ﯾَﺴْﺘَﻨْﺒِﻄُﻮﻧَﮧ، ﻣِﻨْﮭُﻢْ۰۰
Tarjuma: “ Aur agar is mein RASOOL aur Amr waaley logoon ki taraf Rojoo’e kartey to zarur un mein se Haqeeqat jaan letay woh jo istinbaat karety hain”
(Parah#5, Surah Nisa,' Aayat#83)
Is se saaf maaloom huwa k Ahaadees aur Akhbaar aur Qurani Aayaat ko pehley istinbaat karney waley Ulama k saamney Pesh karey phir jis tarah woh farmadein us par amal Karein , Khabar se badh kar Quran o Hadees hai, lihaaza is ka Mujtahid par Pesh karna Zaroori hai.
Aayat#10:
ﯾَﻮﻡَ ﻧَﺪْﻋُﻮْﺍ ﮐُﻞَّ ﺍُﻧَﺎﺱِِمـ ﺑِﺎِﻣَﺎﻣِﮭِﻢ۔
Tarjuma: “ Jis din har Jama’at ko ham us k Imam k Sath bulaenge “

ﺍﻭ ﻣﻘﺪﻡ ﻓﯽ ﺍﻟﺪﯾﻦ ﻓﯿﻘﺎﻝ ﯾﺎ ﺣﻨﻔﯽ ﯾﺎ ﺷﺎﻓﻌﯽ۔
Tarjuma: “ Ya Imam Deeni Peshwa hai, Pas Qayaamat main kaha jawey ga, k Ae Hanafi, Aey Sha’fai “..

Is se maaloom huwa k Qayamat k din har insaan ko us k Imam se Bulaya jawey ga , Yun kaha jawey ga, k Ae Hanafiyon , Ae Shafiyo, Ae Malakiyo, Chalo !
To jis ne Imam hi na pakda us ko kis k saath bulaya jawey ga
Is k baarey mein Sofiya e Kiram farmaatey hain k jis ka koi Imam nahin us ka Imam Shaitaan hai .
Aayat#11
وَاذَِﺍ ﻗِﯿْﻞَ ﻟﮭُﻢ ﺍٰﻣِﻨُﻮا ﮐﻤَﺎ اٰﻣَﻦَ ﺍﻟﻨَّﺎﺱُ ﻗَﺎﻟُﻮآ ﺍَﻧُـؤْﻣِﻦُ ﮐَﻤﺎ ﺍٰﻣَﻦَ ﺍﻟﺴُّﻔَﮭـَآﺀُ۔
Tarjuma: “ Yaani jab un se kaha jaata hai, k aeisa
Eemaan lao jaisa yeh Mukhlis Momin Eeman lae to kehtey hain k kiya ham aesa Eemaan laaein jesa yeh Be-waqoof Eemaan lae.*

Maaloom huwa k Eemaan bhi wohi Mu’a’tabar hai jo Saaliheen ka sa ho , to Mazhab bhi wohi theek hai jo Neik Bandoon ki tarah ka ho , aur woh Taqleed hai
AQWAAL E MUFFASAREEN WA MUHADDISEEN
دارمی باب الاقتدا ء بالعلمآء میں ھے
اَخْبَرَنَا یَعْلٰی قالَ اخبرنا عبدُ الْمَلِكِ عـــن عَطــــــاءٍ اَطـــــِیْعُوااللّٰهَ وَاَطيعُوا الرَّسُوْلَ واُولِى الْاَمْــــــرِ مِنْكُم قَالُوْااُوْلُوالْعِلْـــــــــمـــِ وَالْفِــــقْهِ
Khabar di hamko ya'alaa ne unhun ne kaha, mujhse kaha. Abdulmalik ne unhoone Ata' se riwayat ki keh eta'at karo Rasool ki (صلی الله علیہ وسلم) aur apne mein se amr (hukm) waloon ki, farmaya At'a ne ke aulool amr ilm aur fiqah wale hazrat hain
تـــفســــیر خازن زیر آیت فاسئلوا اھل الذکران کنتم لا تعلمون۰ فسئلوا المؤمنـــــینِ العٰلِمـیــــن مــــــن اھل
القــــــرآن
Tum unse puchho jo momin hain aur quran janne wale ulama hain *
تـــفسير درمنثوراسى آيت فاسئلوا الخـ.كى تفسير ميں هے
اَخرج اِبن مردَوَیْہ عــــن انسٍ قال سمعتُ النَّبیَّ صلی الله علیہ وسلمـــ یقول اِنَّ الرجلَ یُصَلِّی ویَصُومُ و یَحِجُّ وَیَغْزُو وَاِنَّہ لَمُنافقٌ قالوایارسول الله بِمَاذا دَخَلَ علیہ النَّفَاقُ قال َلِطَعْنِہ علٰی امامِہ وامامَہ، مَن قَال قالَ اللّٰه فِی کتابِہ فاسئلوا اھل الذکر ان کنتم لا تعلمون۰
Ibne mardaweih ne Hazrat Anas se riwayat ki, Farmate hain keh maine Huzoor علیہ السلام se suna ke farmate the ke baa'z shakhs Namaz padhte hain, roze rkhte hain, Haj, aur jihaad karte hain Halaanke woh munafiq hote hain, Arz ki ya rasoolullah kis wajah se un mein Nifaq a'gaya farmaya gaya apne imam par ta'nah (malamat) karne ki wajah se imam kaun hai? farmaya keh Rabتعالی ne farmaya
فاسئلوا. الآية٠
تفســــير صاوى سوره كهف وَاذْكُرْرَبَّكَ إذَانَسِيْتَ ki tafseer mein hai
وَلایجوزُ تقلید ماعَدَاالمذاھب الاربعۃَولو وافق قولَ الصحابۃِ والحدیْثَِ الصَّحیحَ والآیۃ َوالخارجُ عن المذاھب الاِربعۃَضَالٌّ مُّضِلٌّ وَّرُبَمَا اَدَّاہ ذٰالک الی الکفر لأنَّ لاَخذَ بظواھر الکتاب والسنَّۃِ من اُصول الکفر
Yani char 4 mazhaboon ke siwa kisi ki taqleed jaiz nahein, agarche woh sahaba ke qaul aur saheeh hadees aur ayat ke muwafiq hi ho, jo in char mazhaboon se kharij hai woh gumraah aur gumraah karne wala hai, kiyun ke Hadees wa qura'n ke mahaz zahiri ma'na lena kufr ki jad hai
AHADEES. احاديث
Muslim 1/54 Bab. Bayan. انَّ الدِّینَ النَّصیحۃُ mein hai
عن تمیم الدَّارِی اَنَّ النَّبِیَّ صلےاللہ علیه وسلم قال الدِّینُ النَّصیحَۃُ قلنا لمن قال لِلّٰہِ ولکِتابِہ وَلِرَسولِہ ولِاَئِمَّۃِ الْمُسْلِمین وعامَّتِھِمْ
Tameem dari se marwi hai keh Huzoor صلےاللہ علیہ وسلم ne farmaya keh deen khair khawahi hai Ham ne Arz kiya kis ki?
farmaya Allah ki aur uski kitab ki aur uske rasool ki aur musalmanun ke imamoon ki Aur A'm mu'minoon ki
Is hadees ki sharah mein Nawi mein hai
وقد يتناول ذالك على الأئمَّة ِالذين هم علمآءُالدين وإن من نصيحتهم قبول مارَوَوْهُ وتقليد هم فى الاحكام واحسانَ الظَّنِّ بِهم
Yeh hadees un imaamun ko bhi shamil hai jo ulamaae deen hain aur ulamaa ki khair khawahi se hai unki ruwayat ki huwi Ahadees ka qabool karna aur unke Ahkam mein taqleed karna unke sath neik guman karna,
DUSRI FASL TAQLEED E SHAKHSI KE BAYAN MEIN
Mishkat Kitab ul Emarah mein Ba-hawala Muslim hai keh HUZOOR (Sallalaho Alehe Wassallam) Farmaatey hain..
من اَتاکمُ وِاَمْرُکُم جَمیعٌ علی رجلِِ َواحِدِِیُّریْدُ ان یَّشُقَّ عصاکم ویُفَرِّقُ جَماعَتَکم فَاقْتُلُوہ..
Tarjuma: “Jo tumharey pass aawey Halaankey tum ek Shakhs ki Ata’at par Muttafiq ho , woh Chahta ho keh tumhari Laathi tod de, aur tumhari Jama’at ko Mutafarriq (juda) kar de, to us ko Qatal kardo*
Is mein murad Imam aur Ulama-e-Deen hi hain, kiyun keh Haakim e Waqt ki Ita’at Khilaaf e Shara'e Ahkaam mein Jaiz nahin Muslim ne Kitab ul Ammarah mein ek Baab baandha
ﺑﺎﺏ ﻭ ﺟﻮﺏ ﻃﺎﻋـۃِﺍﻻُﻣَﺮَﺍﺀ ﻓﯽ ﻏﯿﺮ ﻣﻌﺼﯿـۃ

Yaani Ameer ki Eta’at Gair Ma’siyat main Waajib hai , is se Maloom huwa k ek hi ki Eta’at Zaroori hai*
Mishkat Shareef kitabul buyooe babul faraiz mein Ba-riwaayat Bukhari hai k, Hazrat Abu Moosa Ash’ari ne Hazrat Ibn-e-Mas’ood ke
baarey mein Farmaya,
ﻻﺗَﺴْﺎَﻟُﻮْﻧِﯽ ﻓﯽ ﻣﺎﺩﺍﻡَ ﮬﺬﺍ ﺍﻟﺤﺒﺮُ ﻓﯿﮑﻢ
Jab tak keh yeh Allama tum mein Rahein, Mujh se Masail na puchho. .
(Sahih Bukhari, Kitaab ul faraeiz, Jild#2,Pa/997)
Maloom huwa keh Afzal ke Hotey huwey, Mafzool ki Eta’at na karey, aur har Muqallid ki Nazar mein apna Imam Afzal hota hai,
Fath-ul-Qadeer mein hai:
مَنْ تَوَلّٰی أَمْرَالْمُسْلِمِیْنَ شَیـئََافاسْتَعْمَلَ عَلَیْھِم رَجُلََاوَّ یَعْلَمُ أنَّ فیھِم من ھو اَولٰی بذالِکَ وَاعْلمُ منہ بکتَابِ الله وسُنَّۃِ رسُولِہ فقَدخانَ اللهَ ورسولَہ وجماعۃَالمسلمین
Tarjuma: “Jo Shakhs Musalmaanon ki Hukoomat ka Maalik ho, phir un par kisi ko Haakim banaey , Halankey jaanta ho k Musalmaanon mein is se ziyadah Mustahiq aur Quran o Hadees ka jaanney wala hai , to us ne ALLAH aur RASOOL (Alehissalam) aur Aam Musalmaanon ki Khayanat ki ”
Mishkat Kitaab ul ammarah Fasal Awwal mein hai,
ﻣﻦ ﻣﺎﺕ ﻭﻟﯿﺲ ﻓﯽ ﻋُﻨُﻘِﮧ ﺑَﯿْﻌَـۃٌ ﻣﺎﺕ ﻣَﯿْﺘـَۃَ ﺟَﺎﮬِﻠِﯿَّـۃِِ۔۔
Tarjuma: “ Jo Mar jaey, Halankey us ke Galey mein kisi ki Bai’at na ho, woh Jahalat ki Moat mara ”
( ﻣﺸﮑﻮٰۃ ﺷﺮﯾﻒ ﮐﺘﺎﺏ ﺍﻻﻣﺎﺭۃ ﻭﺍﻟﻘﻀﺎﺀ ﺍﻟﻠﻔﺼﻞ ﺍﻻﻭﻝ ۳۲۰، ﻣﻄﺒﻮﻋﮧ ﻧﻮﺭ ﻣﺤﻤﺪ
ﮐﺘﺐ ﺧﺎﻧﮧ ﮐﺮﺍﭼﯽ )
Is main Imam ki Bai’at yaani Taqleed aur Bai’at e Auliya sab hi daakhil hain , warna Bataaow Wahhabi is Zamaney mein kis Sultan ki bai’at mein hai.. ??
Ye chand Ayaat aur Ahaadees thein uske elawah aur bhi pesh ki ja sakti hain magar ikhtisaran usi par Qana'at ki gayei
Ab ummat ka amal dekho to taba'e taba'een ke zamane se abtak sari ummate marhumah is hi taqleed ke A'mil hain ke mujtahid nah ho woh ek mujtahid ki taqleed kare aur ijmae ummat par amal karna quran o hadees se sabit hai aur zaruri hai
Quran farmata hai:
وَمَنْ یُّشَاقِقِ الرَّسُولَ مِن بَعْدِماتَبَیَّنَ له ھُدیٰ وَیَتَّبِعْ غَیْرَسَبِیْل الْمؤمِنِینَ نُوَلِّہ مَاتَوَلّٰی وَنُصْلِہ جھنَّمَ وسآءَتْ مَصیرَ۰
Tarjuma: “ Aur jo RASOOL ki Mukhalifat kare aur Baad is key keh Haq Raasta is par khul chukka aur Musalmaanon ki Rah se juda raasta chaley ham us ko uski Haalat par chod denge , aur us ko Dozakh mein Daakhil karenge, aur kiya hi, buri jagah palatney ki hai

Jis se Maaloom huwa k jo raasta aam musalmaanon ka ho us ko ekhtiyar karna Farz hai aur Taqleed par Musalmaanon ka Ijma ( Yaani Musalmaanon ki Ziyadah Tadaad is Mas’aley k Haq mein) hai *
Mishkat Bab Al-Etesaam Bil Kitab o Sunnat mein hai..
اتبعوا السَّوَادالاَعظم فإنه من شَذَّشُذَّفى النار
Tarjuma: “ Badey Giroh ki Perwee karo, q k jo Jamat-ul-Muslimeen se Alahada raha, woh alahada kar k Jahannam mein Bheja Jawey ga”..

Ab dekhna yeh hai keh Aaj bhi aur is se pehley bhi Aam Musalmaan Taqleed E Shakhsi hi ko achha jaantey aae, aur Muqallid hi huwey , Aaj bhi Arab o Ajam mein Musalmaan Taqleed E Shahksi hi kartey hain , aur jo Gair Muqallid huwa woh Ijma ka Munkir huwa , Agar Ijma ka Etebar na karo, to Khilafat-e -Siddiqui o Farooqi kis tarah Saabit karogey, woh bhi to Ijma e Ummat se hi saabit huwi, yahaan tak k jo Shakhs in donon Khilaafaton mein se kisi ek ka Bhi Inkar karey woh kaafir hai ..

Tafseer e Khazin Zer e Aayat ﻭﮐﻮﻧﻮﺍ ﻣﻊ ﺍﻟﺼّٰﺪﻗﯿﻦ

AQLEE DALAIL..
Duniya mein Insan koi bhi kaam bageir Dusre ki perwee k nahin kar sakta, har Hunar aur ilm ke Qawaeid sab mein is k Mahireen ki Perwee karna hoti hai, Deen ka Muaamla to duniya se Kahin Ziyadah mushkil hai, is mein bhi is k Mahireen ki Perwee karna hogi..
Ilm e Hadees mein bhi Taqleed hai , k fulaan Hadees is liye Za'eef hai, k Bukhari ne ya fulaan Muhaddis ne Fulaan Raawi ko Za'eef kaha , is ka Qaul manna yeh hi to Taqleed hai , Quran ki Qir’at mein qariyon ki Taqleed hai , k Fulaan ne is tarah is Aayat ko padha hai, Qur’an k A'eraab, Aayaat sab meinTaqleed hi to hai , Namaz mein jab Jama’at hoti hai to Imam ki Taqleed sab Muqtadi kartey hain.
Hukumat-e-Islami mein Tamaam Musalmaan ek Badshah ki Taqleed kartey hain..
Rail (Train) main Bethtey hain, to ek Engine ki Saarey Rail (Train) waaley Taqleed kartey hain .. Gharz yeh k Insan har kaam mein Muqallid hai, aur khayal rahey k in sab soorton mein Taqleed e Shakhsi hai , Namaz ke Imam do (2) nahin, to Shari’at mein aap kis tarah 2 Imam Muqarrar kar saktey ho?

Ek Wahiyat Taaney aur Tamaskharey (Illogical baaten) jin ke jawabaat zaruri nahin Dusre wo jis se Muqallideen ko Gair Muqallid dhoka
detey hain.aur A'm muqallideen dhoka kha lete hain, woh hasb zel hain
SAWAAL NO 1 :
Agar Taqleed zaruri thi to Sahaba e Kiram Muqallid kiyun na huwey?
Jawab:
Sahaba e Kiram ko kisi ki Taqleed ki zarurat na thi, woh to Huzoor (Sallalaho Alehe Wassallam) ki Sohbat ki barkat se tamaam Musalmaanon ke Imam aur Peshwa hain , keh Aaeimma E Deen Imam Abu Haneefah O Shafa’i wagerah (Radi ALLAH Anhuma) in Sahaba ki perwee kartey hain ..
Mishkat Baab Fazaeil ul Sahaba mein hai..
اصحابى كاالنجوم بِاَيِّهِم اِقْتدَيتُم إهتديتم
Tarjuma: “ Mere Sahaba sitaron ki tarah hain, tum jin ki Perwee karo ge, Hidayat paalo gey” (Mishkat Page#554,)
Ek aur jagah aata hai:
علیْکُمـ ْبِسُنَّتِی وَسنةِ الخُلَفآءِ الرَّاشِدیـــنَ
Tarjuma: “ Tum lazmi pakdo meri aur merey Khulafa e Rashideen ki Sunnat ko” (Sunan Ibn-e-Majah, Jild#1, Page#15-16, Raqam ul
Hadees 42-43,)
Yeh suwal to aeisa hai k jeisey koi kahey k ham kisi ke Ummati nahin, kiyun keh hamarey NABI (Sallalaho Alehe Wassallam) kisi ke Ummati na they , to Ummati na hona Huzoor (Sallalaho Alehe Wassallam) ki sunnat huwi , par us se kaha jaega k Huzoor (Sallalaho Alehe Wassallam) to khud Nabi hain , sab AAP ki Ummat hain ,woh kis ke Ummati hotey, hamko ummati hona zaruri hai, isi tarah Sahaba tamam Musalmaanon ke Imam hain , unka kaun Musalmaan Imam hota
Nahar se pani us khet ko diya jaeega jo darya se door ho, mukabbireen ki aawaz par wahi Namaz padhega jo imam se door ho, darya ke kinare wali khetun ko Nahar ki zarurat nahein, pahli suf ke muqtadiyun ko mukabbir ki zarurat nahein Sahaba e kiram saffe auwal ke muqtai hain woh bila wasta seena-e- pake Mustafa. صلی اللہ علیہ وسلمse faiz lene wale hain, ham chunkeh us darya se door hain, lihaza us nahar ke hajat mand hain, phir samandar se hazar ha darya jari hote hain jin sab mein pani to samandar hi ka hai magar un sab ke Nam aur raste alag hain koi ganga,kahlata hai koi jamna, Aise hi Huzoor Alaihissalam Ap Ramat ke samandar hain us seene mein se JO nahar iamam Abu hanifah ke seene se hoti.aaei use HANAFI kaha gaya, jo iamam malik ke seene se aaei use MALIKI KAHLAYA, pani sab ka ek hai magar nam juda gana Aur un Nahrun ki hamain zarurat padi nah ke sahaba e kiram ko jaise hadees ki isnad hamare liye hai hai nah ke sahaba ke liye
SAWAAL NO 2 :
Rahbari k liye Quran o Hadees kafi hain, in mein kiya nahin hai jo Fiqah se hasil karain Quran Farmaata hai:
وَلَارَطْبِِ وَّلایَابِسِِ اِلَّافِی کِتَابٍ مُّبِیْنٍ۰
Aur nahi hai koi tar aur khushk chiz jo ek roshan kitab mein likhi na ho = ( ﺳﻮﺭۃ ﺍﻟﻨﻌﺎﻡ ﺁﯾﺖ 59 )
Ek aur jagah aata hai:
وَلَقَدْیَسَّرْنَاالْقُرْآنَ للذِّکْرِفھَلْ مِن مُّدَّکِرٍ ۰
Tarjuma: “ Aur ham ne Quran ko Yaad karney k liye Aasaan farma diya, to hai koi Yaad karney wala” ..
(Parah#27, Surah#54, Aayat#17)
In Aayaton se Maloom huwa keh Quran mein sab kuch hai aur Quran sab ke liye Asaan bhi hai phir kisi Mujtahid ke Pass q Jaein?
Jawab:
Quran o Hadees beshak Rahbari ke liye Kaafi hain aur inmein sab kuchh hai magar unse masail nikalne ki qabiliyat hona chahiye samandar mein moti hain magar unko nikalne keliye gota zan (dubne wale) ki zarurat hai Aimma-e-mujtahideen is samandar ke gota zan hain, Tib (doctori) ki kitaboon mein sab kuchh hai magar hamko Hakim ke pas jana aur usse nuskha tajwiz karana zaruri hai, aimma e deen tabib hain. ولقد یسرناالقرآن. Mein farmaya hai ke hamne quran ko hifz karne ke liye aasan farmaya" (parah#27surah#54ayt#17)
nah ke usse masail nikalne ke liye Agar masail nikalna aasan hai to phir hadis ki bhi kiya zarurat hai aur quran mein sabkuchh hai, quran aasan hai, niz quran sikhaane keliye Nabi kiyun aaey, quran mein hai
وَیُعَلِّمُھُمُ الْکِتَابَ وَالْحِکْمَۃَ
Aur woh nabi unko kitabullah aur hikmat ki batain sikhate hain"
(parah#1,surah#2,ayat#129) quran o hadees Ruhaani dawaein hain aur Imam.ruhani tabib
SAWAAL NO 3 :
Quran e Kareem ne Taqleed karney waalon ki Buraiyan farmai hain, Farmaata hai
اِتَّخَذُوْا اَحْبَارَھُمْ وَرُھــْبَانَھُــمْ اَرْبَابََامًّـــنْ دُوْنِ اللّٰه ِ
Tarjuma: “Inhon ne apney Padriyon aur Jogiyon ko ALLAH ke Siwa khuda bana liya”
فَاِنْ تَنَازَعْتُم فِی شَیْئٍ فَرُدُّوْہُ اِلَی اللّٰه وَالرَّسُوْلِ'
Phir agar tum mein kisi bat ka jhagda uthe to Allah aur uske rasool ki taraf rujoo'e karo
واَنَّ.ھٰذَا صِرَاطِیْ مُسْتَقِیْمـاََ فَاتَّبِعُوْہُ وَلَاتَتَّبِعُواْالسُّبُلَ فَتَفَرَّقَ بِکُم
Tarjuma: “ Aur yeh k yahi mera Seedha Rasta hai to us par Chalo aur Raahein na chalo, keh tum ko us ki Raah se juda kar dengi”
قالُوابَل نَتَّبِعُ مَا اَلْفَیْنَا عَلَیہِ اٰبآءَنَا
Tarjuma: “To kaheinge balkey hum to us par Chalenge jis par apney Baap Dada,. ko Paya”
In Aayaat aur in jaisi dusri Aayaton se maloom hota hai k ALLAH aur RASOOL ke Hukum ke saamney Imamon ki baat manna Tareeqah-e-Kuffar hai aur seedha Rasta ek hi hai, Char Raastey Hanafi, Shafa’I wagerah Tedhey rastey hain..
Jawab:
Jis Talqeed ka Quran e Kareem ne mana kiya un ka Jawab hum pehley hi bab mein bayan kar chukey hain, (lihaazah aap Shuroo se is topic ko read out karlein..)
ﻭَﻻتَـَﺘَّﺒِﻌُوﺍﺍﻟﺴُّﺒُﻞَ
(Parah#5, Surah#4, Aayat#59)
Mein Yahoodiyat ya Nasraniyat wagerah Khilafe Islam raastey murad hain ..
Hanfi , Sha’fai wagerah chand alag alag raastey nahin, Balkeh ek Station ki Char(4) Sadkein hain , ya ek Darya ki Char (4) Nehrein hain , warna phir to Ger Muqallideen ki Jama’aten Sanai aur Gaznawi ka kiya hokum hai ? Chand raaste hote hain aqaid ke badalne se,(lekin hamare) Chaaron (4) Mazhab ke Aqaid Ek hi hain, Sirf Aamaal mein Faro'i Mas’ala hain, jesa ke Khud Sahaba Kiram mein Ikhtalaf raha

ســـــــــوال. ﮨﻮﺗﮯﮨـوﮰ ﻣﺼﻄﻔﯽٰکی ﮔﻔﺘﺎﺭ
ﻣﺖ ﻣﺎﻥ ﮐﺴﯽکـﺎ ﻗﻮﻝو کردار
ﺩﯾﻦ ﺣﻖ ﺭﺍﭼﺎﺭ ﻣذھﺐ ﺳﺎ ﺧﺘﻨﺪ
ﻓﺘﻨﮧ ﺩﺭ ﺩﯾﻦ ﻧﺒﯽ ﺍندﺍ ﺧﺘﻨﺪ !

Yeh Shair asal mein Chakralviyon ka hai (Chakralvi woh hain, jo Hadith ko nahin maantey )
ﮨﻮﺗﮯ ﮨﻮﮰ ﮐﺒﺮﯾﺎ ﮐﯽ ﮔﻔﺘﺎﺭ
ﻣﺖ ﻣﺎﻥ ﻧﺒﯽ ﮐﺎ ﻗﻮﻝ ﻭ کـﺮدﺍﺭ

ﺁﺗﺶ ﻭ ﺁﺏ ﻭ ﺧﺎﮎ ﻭ ﺑﺎﺩﺳﺐ ﮐﺎ ﺍﻧﮩﯽ ﺳﮯ ﮨﮯ ثبات
ﭼﺎﺭ ﮐﺎ ﺳﺎﺭﺍ ﻣﺎﺟﺮﺍ ﺧﺘﻢ ﮨﮯ ﭼﺎﺭ ﯾﺎﺭ ﻣﯿﮟ
Char (4) ka Number to ALLAH عزوجل ko Bada hi piyara hai, Kitaben bhi Char (4) Bhejin , Aur Deen bhi Char(4) Banaey Insan ka Khameer bhi Char (4) hi cheezon se kiya Wagerah, jab maqsood ke char raste ghir gaye to wahan pahunchna na mumkin hai, Khana e ka'aba k Ird Gird Char (4) Taraf Namaz hoti hai,
Magar Rukh sab ka Kabey ko hota hai .
Aeise hi Huzoor (صلی اللہ علیہ وسلم) to Kaba e Eemaan hain, Charon Mazhabon ne Charon Raastey Gher liye hain ,
Wahhabi kis Raastey se Wahaan puhnchenge

ﻣـذﮨﺐ ﭼﺎﺭﭼﻮﮞﭼﮩﺎﺭ ﺭﺍﮦاند
ﺑـہـﺮِ ﻣِﻨّﺖ ﺟُﻮ ﺟﺎﺩﮦ ﭘﯿﻤﺎﯼٔ
ﺧﻮﺩ ﯾﮑﮯ ﺑﯿﻨﯽ ﺍﺯ ﭼﮩﺎﺭ ﻃﺮﻑ
ﮐﻌﺒﮧ ﺭﺍﭼﻮﮞ ﺗﻮ ﺳﺠﺪﮦ ﺑﻨﻤﺎﯼٔ
Jis tarah Quran ke Hotey huwey Hadees ki zarurat hai ,usi Tarah Hadees ke Hotey huwey Fiqah ki Zarurat hai , Fiqah Qur’an o Hadees ki Tafseer hai, aur jo Hukum ke ham ko na Hadees mein miley na Qur’an mein, us ko Fiqah hi bayan farmaata hai
SAWAAL NO 5 :
Taqleed mein Gair E Khuda ko apna Hakam(faislah karne wala) banana hai, aur yeh Shirk hai. Lihaza taqleede shakhsi shirk hai Rabتعالٰیfarmata hai.َّ اِنِ الْحُکْم َاِلَّا لِلّٰهِ Nahein hai hukm magar Allah ka?
Jawab,:
Agar ghaire khuda ko hakam ya panch bana shirk hai To Hadees Maanna bhi Shirk hi hoga, aur is ke Sath sath Saarey Muhaddiseen , Mufassireen Mushrik hogaye, kiyun keh Tirmizi, Abu Dawud, Muslim wagerah Hazrat to Muqallid hain..
ﺟﻮ ﺗﯿﺮﯼ ﺗﻘﻠﯿﺪ ﺷﺮﮎ ﮬﻮﺗﯽ ﻣﺤﺪﺛﯿﻦ ﺳﺎﺭﮮ ﮨﻮﺗﮯ ﻣﺸﺮﮎ
ﺑﺨﺎﺭﯼ ﻭ ﻣﺴﻠﻢ ﺍﺑﻦ ﻣﺎﺟﮧ ﺍﻣﺎﻡ ﺍﻋﻈﻢ ﺍﺑﻮ ﺣﻨﯿﻔﮧ !
ﮐﮧ ﺟﺘﻨﮯ ﻓﻘﮧ ﻣﺤﺪﺛﯿﻦ ﮨﯿﮟ ﺗﻤﮩﺎﺭﮮ ﺧﺮﻣﻦ ﺳﮯ ﺧﻮﺷﮧ ﭼﯿﮟ ﮨﯿﮟ
ﮨﻮﮞ ﻭﺍﺳﻄﮯ ﺳﮯ ﮐﮧ ﺑﮯ ﻭﺳﯿﻠﮧ ﺍﻣﺎﻡ ﺍﻋﻈﻢ ﺍﺑﻮ ﺣﻨﯿﻔﮧ !
Jis riwayat mein ek Fasiq Raawi aajaey, woh riwayat Zaeef ya Mo’zoo hai , to jis Riwayat mein koi Muqallid aajaey to Mushrik aagaya, lihazah woh bhi Baatil ,phir Tarmizi o Abu Dawud to khud Muqallid hain , Mushrik huwey un ki Riwayatein khatam huwin, Buhkari wagerah bhi pehley hi khatam ho chukin,k woh Mushrikon k Shagird huwey, ab Hadees kahaan se laaogey ?
Quran farmaata hai:
وَاِنْ خِفْتُمْ شِقَاقَ بَیْنِھِمَا فَابْعَثُواحَکَمََا مِّنْ اَھْلِہ وَحَکَمََا مِّنْ اَھْلِـــھَــــــــــا
Tarjuma: “Aur gar tum ko miyan Biwi k Jhagdey ka khauf ho to ek Hakam Mard waalon ki taraf Bhejo aur ek Panch Aurat walon ki taraf se Bhejo”(Parah#5,Surah#4Aayat#35)
Hazrat Ali wa Mu’awiyah (Razi ALLAH Anhuma) ne Jang-e-Safeen mein Hakam Banaya hai, Khud Huzoor (Sallalaho Alehe Wassallam) ne Bani Qurezah k Muamle mein Hazrat Sa’d Ibn e Ma’az (Razi ALLAH Anhu) ko Hakam banaya, (Aapney Sawal mein jo Aayat likhi ) is k Meaning yeh hain k Haqeeqi Hakam Khudae Pak hi ka hai, aur jo is k Siwa k Ehkaam hain, Ulama O Fuqha aur Mashaikh ke isi Tarah Ehkaam e Hadees yeh Tamam Bil wasta Khudaey Ta’ala hi k Hukm hain, agar yeh Meaning hon k kisi ka Hukum Siwaey Khuda k Manna Shirk hai to Aaj Tamaam Duniya jajka Faisla Kachehriyon k Muqaddimat ko Maanti hai, Sab hi Mushrik hogaey..
SAWAAL NO 6 :
Qeyaas mujtaheede zan (gumaan) hai, aur zan karna gunah hai Quran khud farmata hai
یَآاَیُّھَاالَّذِیْنَ اٰمَنُوْا جْتَنِبُوْا کَثِیْرََامِّنَ الظَّنِّ اِثْـْمُُ وَّلَاتَجَسَّسُوْا وَلَایَغْتَبْ بَعْضُکُمْ بَعْضََا۰
Aey eiman walo bahut guman se bacho, beshak koi guman gunah hojata hai aur aob nah dhundo, aur ek dusre ki gibat nah karo. Lihaza deen mein sirf kitab o sunnat payr Amal karna chahiye ?

Be-shak Imam Sahab (Razi ALLAH Annhu) ka yeh hokum hai k Agar mera Qol kisi Hadees k Muqabil waqey hojaey to Hadees par Amal karna merey Mazhab par Amal karn hai..
Yeh to Imam Sahab ka Intihai Taqwa hai, K agar aesa hojaey to tum Hadees par Amal karo, ab Ger Muqallidon se Sawal k is Zamaney mein aeisa konsa Muhaddis hai, jo Ahadees ka is Qadar Ilm rakhta ho k Tamaam Hadees phir is ki Tamaam Asnadon par Ittala rakhta ho, aur yeh bhi jaanta ho k Imam Sahab (Razi ALLAH Anhu) ne yeh Hukum kis Hadees se liya hai, hum logon ki Nazar Siha e Sittah se Aagey nahin hoti phir kis tarah Faisla kar saktey hain k Imam Sahab (Razi ALLAH Anhu) ka yeh Farmaan kisi Hadees se Makhooz nahin , Yun to Hadees main bhi aata hai.
اذا بلغكم منى حديث فاعرضوه على كتاب الله فان وافقه فاقبلوه والا فردوه
Tarjuma: “ Jab tum ko meri koi Hadees Puhnchey to us ko KITABULLAH par Pesh karo, agar is k Mawakif ho to Qabool karlo warna Rad kar do”..(Muqadma Tafseerat Ahmediyah, Page#4, Matboo’a Maktabah Islamiyah, Quetta) To agar koi Chakdalwi kahey k bahut Ahadees chunkey Khilaf e Quran hain, isi liye hum Hadees Chodte hain ,Quran mein hai k Meraas Taqseem karo, Hadees mein hai k Nabi ki Meraas Taqseem nahin hoti..
Ab jis tarah yeh Kalam mardood hai, tumhara Qol bhi mardood hai..

Imam E Aazam ko Hadees nahin aati thi, isi liye in ki Riwayat bahut kam hain aur jo hain, wo sab Zaeef,?

Imam E Aazam bahut Bade Muhaddis they , Bagair Hadees Daani is qadar Masail kaise Istimbaat ho saktey the, in ki kitaab Musnade Imam Abu Haneefah aur Imam Muhammad ki kitaab Moa’tta Imame Muhammad se un ki' hadees Daani maloom hoti hai, Hazrat Siddique e Akbar (Radi ALLAH Anhu) ki riwaayat bahut kam milti hain to kiya woh Muhaddis na they?
Kami Riwayat Ehtiyat ki wajah se hoti hai,Imam Sahab ki tamam riwaayat Sahih hain, Kiyun k in ka zamana Huzoor se bahut Qareeb hai ,baad mein Ba’az Riwayat mein Zua’f paida huwa, Baad ka Zu’af Hazrat Imam ko Muzir (nuqsan) nahin karta,phir jis Qadar Asnad badhi, usi Qadar Zu’af bhi Peida huwa.*

Yeh hai k Haq k ma'ana (Meaning) yahaan Sahih ya k Waqeya ke Muwafiq nahin,Balkey Matlab yeh hai keh Charon Mazahib mein se kisi ki Perwee karlo Khuda k yahaan Pakad nahin hogi , Q k Mujtahid ki Khata bhi mu'aaf hai, Ameer e Mu’awiyah aur Maula Ali isi Tarah Ayesha Siddique’ah aur Hazrat Ali (radi ALLAH Anhum Ajma’een) mein jang bhi huwi , aur Haq par ek hi Sahab they, magar donon ko Haq par kaha jaata hai , yaani kisi ki Pakad IndALLAH nahin hogi, Jangal mein ek Shakhs ko Khabar nahin k Qibla (pachhim) kis taraf hai, us ne apni Raaey se Char(4) Rak’at, Char (4) taraf Parhin, q k Raaey badalti gai, yeh bhi Mounh pherta raha, Qiblah to ek hi taraf tha, magar Namaz Sahih hogi Charon (4) Qiblah Durust hain. Balkey Mujtahid Khata bhi karey to bhi ek Sawab paata hai, Quran e pak ne Hazrat Dawud (Alehs Salaam) ki ijtihaadi Khata aur Hazrat Suleman (Alehis Salam) ki Durusti raaey bayaan farmai, magar kisi par Etab na farmaya Balkey farmaya
ﮐـُلََّا ٰﺍﺗَﯿْﻨَﺎ ﺣُﮑْﻤََﺎ ﻭَ ﻋِﻠْﻤََﺎ,,
ﻣﺸﮑﻮٰۃ ﮐﺘﺎﺏ ﺍﻻﻣﺎﺭۃ ﺑﺎﺏ ﺍﻟﻌﻤﻞ ﻓﯽ ﺍﻟﻘﻀﺎﺀ ﻣﯿﮟ ﮨﮯ
اذا حكم الحاكم فاجتَهَدَ وَاَصَابَ فَلَه اَجرانِ واذاحكم فاجتهدفاَخْطَأَ فله اجرواحد
Tarjuma: “Jab k Haakim Faisla karey to ijtihaad kare aur Sahih karey to us ko Do (2) Sawab hain, aur jab Faisla karey aur ijtihaad karey aur Khata karey to us ko ek (1) Sawab hai(Mishkat ul Fasal ul Awwal, Page#324)
Is se yeh Aetraaz bhi uth gaya k agar Sha’fai Rafayaden karey to theek hai aur agar Geir Muqallid karey to Jurum hai, Q k Sha’fai Haakim e Shara Mujtahid se faisla kara kar Rafa’yaden kar raha hai, agar Galti karta hai to bhi Maaf hai, aur Chunkey Geir Muqallid ne kisi Mujtahid se faisla na karwaya, lihazah agar Sahih hi karta hai, tab bhi Khata kaar hai, jeisay k aaj agar Haakim k bager koi shakhs khud hi Qanoon ko haath mein le kar koi kaam karta hai to Mujrim hai, lekin agar Haakim Kachehri se Faisla kara kar woh hi kaam kiya to is par Jurm nahin , Haakim Jawab dey hoga, aur agar Haakim se bhi galti hogai, to bhi us ki pakad nahin hogi ..
Dekho Huzoor (Sallalaho Alehe Wassallam) ne Badar k Qediyon se Mahaz Qiyas par Fidya liya phir Aayat is k khilaaf aai, Maloom huwa k is Qiyas se Rab raazi nahin , Magar woh Fidyah ka Rupiya waapas na krwaya gaya, Balkey Irshaad huwa, ﻓَﮑُﻠُﻮْﺍ ﻣِﻤَّﺎ ﻏَﻨِﻤْﺘُﻢْ ﺣَﻼﻻً ﻃَﯿِّﺒﺎً
(Parah#10,Surah#8, Aayat#69) Woh Maal kha lo halale taiyib, Maloom huwa k Khata e Ijtihaadi par koi Pakad nahin

Qiyas k mana(Meaning) Lughat mein Andazah Lagana aur Shari’at mein kisi Fare’I Mas’ale ko Asal Mas’aley se illat aur Hukum mein Mila dena, Yaani ek Mas’ala aeisa Dar-Pesh aagaya, jis ka Saboot Quran o Hadees mein nahin milta to is ki Misl koi woh Mas’ala liya jo Quran o Hadees mein hai,us ke Hukum ki illat(Wajah)maloom kar ke yeh kaha keh Chunke woh illat yahaan bhi hai, lihaazah us ka yeh Hukum hai,
jaise kisi ne Puchha keh Aurat ke saath Iglaam (pichhe k muqam mein wati karna) karna keisa hai? Hum ne Jawab diya k Haalat-e-Hez main Aurat se Jama’a karna Haram hai, kiyun ?
Paleedi(napaki) ki wajah se, aur is mein bhi Palidi hai, lihaazah yeh bhi Haram hai , Pucha gaya k jis Aurat se kisi k Baap ne Zinaa kiya woh is ke liye Halaal hai ya nahin?
hum ne kaha k jis aurat se kisi ka Baap Nikah karey woh Bete ko Haraam hai, Wati ya Juziyat ki wajah se, lihaazah yeh aurat bhi Haraam hai , is ko Qiyaas kehtey hain, Magar Shart yeh hai k Qiyas karney waala Mujtahid ho , har kisi ka Qiyas Mu’tabar nahin ,
Qiyas asal mein Hukum e Shari’at ko zaahir karney waala hai khud mustaqil Hukum ka musbit nahin , Yaani Quran o Hadees ka Hukum hota hai, magar Qiyas isko yahaan
zaahir karta hai, Qiyas ka sabut Quran o Hadis o Af’aal e Sahaba se sabit hai.Quran farmata hai
ﻓَﺎﻋْﺘَﺒِﺮُﻭْﺍﯾـَآاُﻭْﻟِﯽالْاَﺑْﺼَﺎﺭِ۔
Tarjuma: “To Ibrat lo, Ae Nigah waalo”
(Parah#28,Surah#59,Ayat#2)
Yaani Kuffar k Haal par Khud ko Qiyas karo,keh Agar tum ne aeisi Harkat kin to tumhara bhi yahi haal hoga.Neez Quran ne Qayamat k honey ko Neend par,isi Tarah kheti k khushk ho kar SarSabz hone par Qiyaas farma kar bataya hai, Auwal se Aakhir tak Kuffar ki misalein Bayaan farmai hain, yeh bhi Qiyas hai.,.
Buhkari Kitab ul Aetisaam mein ek bab bandha hai
بابُ مَن شبَّهَ اَصْلاً مَّعلوماً بِاَصلِ مُّبينٍ قد بَيَّنَ اللّٰه حُكْمَهَا لِیَفْھَمَ بِه السَّائلُ
Jo kisi qaeidah-e-malumah ko aise qaeidah se tashbeeh de jiska hukm خدائےتعالیٰne bayan farma diya hai takeh saail us se samajh le* (Sahih Bukhari, Kitab ul Aetasaam, Jild#2, Page#1088, Matboo’a Qadeemi
Is mein (bab mein jo mazkur hu'a) ek Hadees Naqal ki, jis mein Huzoor(علیہ السلام) ne ek Aurat ko Qiyas se Hukum Farmaya:
انَّ امرأۃً جاءتْ الی النبی صلی الله علیہ وسلم فقالت ان اُمِّی نذرت اَن تَحُجَّ اَفَاَحُجُّ عنھا قال نعم حُجِّی عنھا ارءَیتِ لوکان. علیٰ اُمُّکِ دَین اَکنتِ قاضیۃٍقالت نعم قال اِقْضُوالَّذی له فان الله احَقُّ بالوفاءِ
Tarjuma: “Ek Aurat Huzoor (علیه السلا ) ki khidmat mein Haazir huwi, aur Arz kiya, k Meri Waalidah ne Hajj ki Nazr maani thi, kiya main us ki taraf se Hajj karun ? Huzoor ne Farmaya Haan Karo, Agar tumhari Maa par Qarz hota to tum usey Ada Kartin,Aurat ne Arz ki, haan karti, Huzoor ne Farmaya, Woh bhi Qarz ada karo jo ALLAH ka hai, q k ALLAH Ada-e-Qarz ka ziyadah Mustahik hai.(Sahih Bukhari,Jild#1,Page#25)
Mishkaat, kitaab ul Ammarah, aur Tirmizi Jild Awwal,aur Darimi mein hai k Jab Hazrat Mu'az Ibn-e-Jabal ko Huzoor (علیہ السلام) ne Yemen ka Haakim bana kar bheja to Puchha keh kis cheez se Faisla karoge? Hazrat Mu'az Ibn-e-Jabal ne Arz kiya, Kitabullah se, Huzoor ne Farmaya, Agar is mein na Paao to Hazrat Muaz Ibn-e-Jabal ne Arz ki, k ALLAH ke RASOOL ki Sunnat se , Huzoor ne faramya, agar usmein bhi na paao to?
Hazrat Muaz Ibn-e-Jabal ne phir Arz kiya
اجتھد برائی ولا اٰلوقال فضرب رسول اللہ ﷺ علٰے صدرہ وقال الحمدلله الذی وفَّقَ رسولَ رسول الله لِمَایرضٰی به رسول الله
Tarjuma:
Apni Raae se Ijtihaad karunga,Raawi ne farmaya k Pas Huzur (علیہ السلام) ne un ke Seene par Haath maara, aur farmaya,ke us Khuda ka Shukar hai, jis ne Rasool ALLAH k Qaasid ko us ki Taufeeq di, jis se Rasool ALLAH raazi hain صلى الله عليه وسلم

Tarjuma:
Aaj k baad jis kisi pe koi Faisla aajaey to Quran Shareef se faisla karey, agar aesi cheez pesh aagai jo Quran Shareef mein nahin hai to us se Faisla karey jo ALLAH k NABI (Sallalaho Alehe Wa sallam)ne Faisla kiya , lekin aesi Cheez pesh aajae jo na Quran Shareef mein hai aur na us ka Faisla Nabi (Sallalaho Alehe Wa sallam) ne kiya, na Saliheen ne,to apne Qiyas se Ijtihaad karey ”
Imam Nasai isi Hadees k Mutalliq isi Jagah Farmaate hain:Tarjuma Yeh Hadees badi Khari hai, Badi khari hai ”..
(Sunan Nisai,Jild#2, Page#305)Nisai mein isi jagah Hazrat Qaazi Shareeh se riwaayat hai, Farmaya k unhon ne Hazrat Umar (Radi ALLAHAnhu) ki Bargah mein Daryaft kiya k main Faisla kaise karun,to Aap (Umar Radi allahu Anhu) ne jawab diya.
Tarjuma: “ Inhen Hazrat Umar ne kaha k Quran shareef se faisla karo, , agar us mein na ho to Sunnat e Rasool se Faisla karo, aur agar na kitaab mein ho, na Sunnat E Rasool mein to us se Faisla karo jo ALLAH k Naik bandoon ne Faisla kiya ho, (Ijma e Ummat),lekin agar na to woh Mas’ala Quran mein ho, na Sunnat mein , aur na hi is k Mutalliq Saaliheen ka Faisla ho, to chaho to Pesh Qadmi karo,aur chaaho Muhlat lo, main tuhmare liye Muhlat hi ko Behtar jaanta hun.(Sunan Nisai,jild#2, Page#305)
In donon Hadison mein kitab,Sunnat ,Ijma e Ummat aur Qiyas ka aeisa Sareeh Saboot hai keh is ka na Inkaar hoskata hai na Taaweel) ab wo Aetraaz jo Gair Muqallid kartey hain

Is mein Zan se murad Bad-Gumaniyaan hain, yaani Musalmaanon par Bad-Gumaaniyan na kiya karo, isi liye Aayat mein is k Baad geebat wogairah ki mamani'at hai warna qiyas aur gibat meub kiya ta'alluq, jaise keh Rab تعالٰی farmata hai
انَّماالنَّجْوٰی من َالشَّیطٰنِ.

Mashwara karna Shaitan ki Taraf se hai.To kiya har Mashwara Sheitani kaam hai ?Nahin ..! Balkey jo Islam aur Muslamaanon k khilaaf Mashwarey hon, woh Sheitani hain,aise hi yeh hai ,aur jis Qiyas ki Buraiyaan aai hain, woh Qiyas hai jo Hukum e Khuda k Muqabley mein kiya jaey jeisa k Sheitan ne Hukm e Sajdah paa kar Qiyas kiya aur hukm e Ilaahi ko Rad kar diya aur Kufr kiya.Geir Muqallid yeh bhi kahtey hain k Quran farmatahai
ﺍِﻧَّﻤَﺎ ﺍَﺗَّـبِـﻊُ ﻣَﺎ ﯾُﻮ ﺣٰﯽ ﺍِﻟَﯽَّ

اِنَّمَاHasar k liye hai, jis se maaloom huwa k Siwae Wahi k aur kisi Cheez ki Perwee na ki jae, na ijma, na Qiyas ki, Sirf Quran o Hadees ki Perwee ho,magar unhein Maloom hona chahiye k Ijma o Qiyas par amal bhi Quran o Hadees par hi Amal hai k Qiyas ka Muzhir hai ..
Aakhir mei Munkireen-e-Qiyas se Daryaft karta hun k Jin cheezon ki Tasreeh Quran o Hadees mein na miley ya Bazahir Ahaadees se Ta'ruz waqie ho wahaan kiya karogey ?
Maslan: Hawai Jahaz mein namaz parhna kesa hai Isi tarah agar Juma'h ki namaz mein Raka’ate Awwal mein Jama’at thi, Dusri raka’at mein Jama’at Peechey se bhaag gai, ab zohar parhen ya Jumah?
isi tarah dusre masaile qiyasiyah mein kiya jawab hoga, Is liye behter hai k kisi Imam ka Daaman pakar lo,
